T\u00fcrkiye&#8217;de emeklilik ya\u015f\u0131 ve \u015fartlar\u0131 neler diye merak ediyorsan\u0131z, detaylar\u0131 bu yaz\u0131m\u0131zda bulabilirsiniz.<\/strong><\/p>\n<p>Genel olarak \u00fclkelerde erkekler kad\u0131nlara g\u00f6re daha ge\u00e7 ya\u015fta emekli olmaya hak kazan\u0131rlar. Kad\u0131nlar her zaman emeklilik ya\u015f\u0131 a\u00e7\u0131s\u0131ndan daha erken ya\u015fta emekli olurlar. \u00dclkemizde belirli d\u00f6nemlerde \u00e7\u0131kan kanunlara g\u00f6re belirlenen ko\u015fullar veya \u015fartlar\u0131 farkl\u0131la\u015f\u0131r. Ki\u015filerin hangi ya\u015fta emekli olacaklar\u0131, ne zaman emekli olacaklar\u0131 gibi konular hesaplan\u0131rken ki\u015filerin sigortal\u0131 olduklar\u0131 y\u0131l ve ka\u00e7 ya\u015f\u0131nda sigortal\u0131 olduklar\u0131 olduk\u00e7a \u00f6nemlidir. Kad\u0131n ve erkeklerde emeklilik ya\u015f hesaplamalar\u0131nda ki\u015finin \u00f6denen SGK prim tutar\u0131 hesaplamalara dahil edilir.<\/p>\n<h2><strong>Kad\u0131nlarda ve erkeklerde emeklilik ya\u015f\u0131<\/strong><\/h2>\n<p><strong>Erkeklerde ve kad\u0131nlarda emeklilik ya\u015f\u0131<\/strong> hesaplanmas\u0131nda en \u00f6nemli kriter belirli d\u00f6nemlerdir. 1990 \u00f6ncesi ve 2008 \u00f6ncesi gibi d\u00f6nemlerde hesaplama daha farkl\u0131d\u0131r. Belirli d\u00f6nemlerde \u00e7\u0131kan kanundaki \u015fartlar\u0131 ta\u015f\u0131yan ki\u015filer emeklili\u011fe hak kazan\u0131rlar ve bu kanunlarda belirtilen ya\u015f \u015fart\u0131n\u0131 yerine getirdiklerinde emekli ayl\u0131klar\u0131n\u0131 alabilirler.<\/p>\n<p>Ki\u015filer sigortal\u0131 i\u015fe ba\u015flama tarihinde kanunlarda belirlenen kriterlere g\u00f6re e\u011fer t\u00fcm \u015fartlar\u0131 ta\u015f\u0131yorlarsa primlerini tam olarak \u00f6dediklerinde emekli olmaya hak kazan\u0131rlar. Hesaplamalarda baz al\u0131nan en \u00f6nemli kriter \u00f6denen SGK primleridir. Kad\u0131n ve erkeklerin \u00e7al\u0131\u015fmaya ba\u015flad\u0131\u011f\u0131 ve ilk sigortal\u0131 oldu\u011fu tarih, sigorta kolu ve cinsiyet dikkati al\u0131nmaktad\u0131r. Erkekler ve kad\u0131nlar farkl\u0131 zamanlara g\u00f6re emeklili\u011fi hak etmektedir. Cinsiyetle birlikte ki\u015filerin sigortaya ba\u015flang\u0131\u00e7 tarihi ve kanuna g\u00f6re hangi se\u00e7enek kapsam\u0131nda prim \u00f6dedikleri emeklilik ya\u015f\u0131n\u0131n hesaplamas\u0131nda de\u011ferlendirilir. Bunun yan\u0131 s\u0131ra, emeklilik ya\u015f hesaplanmas\u0131nda ve <a href=\"https:\/\/www.kariyer.net\/ik-blog\/emekli-olsam-ne-kadar-maas-alirim-emeklilik-maasi-hesaplama\/\" target=\"_blank\" rel=\"noopener\">emeklilik maa\u015f\u0131n\u0131n hesaplamas\u0131nda<\/a> \u015fu ana kadar kanunen bir\u00e7ok de\u011fi\u015fiklik yap\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>G\u00fcn\u00fcm\u00fczde emeklilik, <a href=\"https:\/\/www.kariyer.net\/ik-blog\/bireysel-emeklilik-sistemi-nedir-avantajlari-nelerdir\/\" target=\"_blank\" rel=\"noopener\">bireysel emeklilik<\/a>, erken emeklilik ve emeklilikte ya\u015fa tak\u0131lanlar i\u00e7in kanunen de\u011fi\u015fiklikler yap\u0131lmaya devam edilmektedir. Bu nedenle de\u011fi\u015fiklik yap\u0131lan kanun hangi y\u0131la aitse o kanundaki maddelere ve \u015fartlara dikkat etmek gerekir. Kad\u0131n veya erke\u011fin \u00e7al\u0131\u015fm\u0131\u015f \u00e7al\u0131\u015fm\u0131\u015f oldu\u011fu tarihte hangi kanun kapsam\u0131na girdi\u011fi emeklilik ya\u015f\u0131 hesaplanmas\u0131nda \u00f6nemlidir. 8 Eyl\u00fcl 1999 y\u0131l\u0131 kad\u0131n ve erkek emeklilik ya\u015f hesaplamas\u0131nda \u00f6nemli bir detay olarak kar\u015f\u0131m\u0131za \u00e7\u0131kar. 8 Eyl\u00fcl 1999 y\u0131l\u0131ndan \u00f6nce ilk defa sigortal\u0131 olarak \u00e7al\u0131\u015fmaya ba\u015flayan ki\u015filerin \u015fartlar\u0131 daha farkl\u0131 belirlenir. Ayr\u0131ca 8 Eyl\u00fcl 1999 ile 30 Nisan 2008 y\u0131llar\u0131 aras\u0131nda ilk defa sigortal\u0131 olan kad\u0131n veya erkeklerin ya\u015f hesaplamas\u0131 da daha farkl\u0131 kriterlere ba\u011fl\u0131d\u0131r. 30 Nisan 2008&#8217;den sonra \u00e7\u0131kan kanun kapsam\u0131na g\u00f6re de bu tarihten sonra ilk defa sigortal\u0131 olan ki\u015filerin hesaplamas\u0131nda emeklilik ya\u015f \u015fartlar\u0131 de\u011fi\u015fir. Dolay\u0131s\u0131yla <strong>erkek ve kad\u0131nlarda emeklilik ya\u015f\u0131<\/strong> hesaplamas\u0131nda 3 d\u00f6nem olduk\u00e7a \u00f6nemlidir. Ayr\u0131ca bu 3 d\u00f6nemde \u00e7\u0131kan kanun d\u00fczenlemelerindeki \u015fartlara g\u00f6re <strong>kad\u0131nlarda emeklilik ya\u015f\u0131 ve prim g\u00fcn say\u0131s\u0131<\/strong> hesaplamalar\u0131 da de\u011fi\u015fmektedir. Kad\u0131nlarda emeklilik prim g\u00fcn say\u0131s\u0131 hesaplamas\u0131 1999 y\u0131l\u0131 \u00f6ncesi sigorta ilk defa sigorta giri\u015fi yap\u0131lan ki\u015filer i\u00e7in 3600 g\u00fcn olarak belirlenmi\u015ftir.<\/p>\n<p>Prim \u00f6deme \u015fart\u0131n\u0131n yan\u0131 s\u0131ra 15 sene sigortal\u0131 olma \u015fart\u0131 bulunur. <strong>Kad\u0131nlarda emeklilik ya\u015f\u0131 ve prim g\u00fcn say\u0131s\u0131<\/strong> hesaplama kapsam\u0131nda 1999 y\u0131l\u0131ndan \u00f6nce ilk defa sigortal\u0131 olanlarda emeklilik ya\u015f\u0131 56 olarak belirlenmi\u015ftir. <strong>3600 g\u00fcnle emeklilik \u015fartlar\u0131<\/strong> kapsam\u0131nda 1999 y\u0131l\u0131ndan \u00f6nce erkeklerde ilk defa sigorta olan ki\u015filerde 3600 g\u00fcn prim \u00f6deme \u015fart\u0131, 15 y\u0131l\u0131 SGK hizmet \u015fart\u0131 ve 58 ya\u015f \u015fart\u0131 bulunur. 9 Eyl\u00fcl 1999 ile Nisan 2008 y\u0131llar\u0131 aras\u0131nda ilk defa sigortal\u0131 olan ki\u015filerin kriterleri daha farkl\u0131 olarak belirlenir. Bu tarihler aras\u0131nda ilk defa sigortal\u0131 olarak \u00e7al\u0131\u015fmaya ba\u015flayan kad\u0131n ve erkekler i\u00e7in 25 y\u0131l sigortal\u0131l\u0131k \u015fart\u0131 \u00f6nemlidir. Ayr\u0131ca 7.000 g\u00fcn primlerinin tam olarak \u00f6denmesi gerekir. 25 y\u0131l sigortal\u0131l\u0131k \u015fart\u0131 ile birlikte prim g\u00fcn\u00fcn\u00fc tamamlayan erkekler 60 ya\u015f\u0131n\u0131 doldurdu\u011funda, kad\u0131nlar ise 58 ya\u015f\u0131n\u0131 doldurdu\u011funda emeklili\u011fe hak kazan\u0131rlar. Bununla birlikte, <strong>kad\u0131n ve erkek emeklilik ya\u015flar\u0131<\/strong> hesaplamas\u0131nda ki\u015filerin hangi mesle\u011fi yerine getirdikleri de \u00f6nemlidir. \u00d6rnek verecek olursak kolluk kuvvetleri biriminde \u00e7al\u0131\u015fan ki\u015filer daha erken ya\u015flarda emeklili\u011fi hak ederler. Bu d\u00f6nemler 08.09.1999 \u00f6ncesi i\u015fe girenler 09.09.1998 y\u0131llar\u0131 aras\u0131 ilk defa sigortal\u0131 olanlar, 30 Nisan 2008 sonras\u0131nda ilk defa sigortal\u0131 olan Ki\u015filerin K\u0131smi emeklilik \u015fartlar\u0131 vard\u0131r. Bu ki\u015filer ya\u015ftan emekli olabilirler. Sigortal\u0131 olarak uzun y\u0131llar hizmet veren bir ki\u015finin <a href=\"https:\/\/www.kariyer.net\/ik-blog\/emekli-olsam-ne-kadar-maas-alirim-emeklilik-maasi-hesaplama\/\" target=\"_blank\" rel=\"noopener\">emekli maa\u015f\u0131<\/a> alabilmesi ve bu talepte bulunabilmesi i\u00e7in sigortal\u0131l\u0131k s\u00fcresindeki hizmet s\u00fcresi, ya\u015f ko\u015fullar\u0131, prim \u00f6deme s\u00fcresini yerine getirmesi gerekir.<\/p>\n<p>\u00d6ncelikle sigortal\u0131l\u0131k s\u00fcresi kad\u0131nlar i\u00e7in 20, erkekler i\u00e7in 25 y\u0131ld\u0131r. Sigortal\u0131l\u0131k s\u00fcresi hesaplan\u0131rken ki\u015filerin sigortal\u0131l\u0131k ba\u015flang\u0131\u00e7 tarihi baz al\u0131n\u0131r. Sigortal\u0131l\u0131k ba\u015flang\u0131\u00e7 tarihi, ki\u015finin i\u015fe ba\u015flamas\u0131 ve sigortal\u0131 olmas\u0131 ile ba\u015flar. Bununla birlikte, yurt d\u0131\u015f\u0131nda \u00e7al\u0131\u015fan ki\u015filer yurt d\u0131\u015f\u0131ndaki hizmet s\u00fcrelerini bor\u00e7lanabilirler. Ki\u015fi sigortaya ba\u015flama tarihinden \u00f6nceki s\u00fcre i\u00e7in bor\u00e7lanm\u0131\u015f ise o zaman bu ki\u015finin sigorta ba\u015flang\u0131\u00e7 tarihi, bor\u00e7lan\u0131lan g\u00fcn say\u0131s\u0131 kadar geriye gidilerek bulunur. \u00d6rnek verecek olursak; ki\u015fi \u00fclkemizde 01.01.2005 tarihinde ilk defa sigortal\u0131 olarak i\u015fe ba\u015flad\u0131ysa ve bu ki\u015fi 01.01.2003 -01.01.2005 tarihleri aras\u0131nda yurt d\u0131\u015f\u0131nda \u00e7al\u0131\u015ft\u0131ysa, bu hizmet s\u00fcrelerini bor\u00e7lanarak \u00f6dedi\u011fi takdirde ilk sigorta ba\u015flang\u0131\u00e7 tarihi 01.01.2003 olarak baz al\u0131n\u0131r.<\/p>\n<p>Emekli olmak i\u00e7in sa\u011flanmas\u0131 gereken \u015fartlardan biri di\u011feri prim \u00f6deme s\u00fcresidir. \u00dclkemizde sigortal\u0131 \u00e7al\u0131\u015fanlar her ay sigorta primi \u00f6derler. Prim \u00f6deme s\u00fcresi sigortaya i\u015fe giri\u015f tarihine g\u00f6re farkl\u0131l\u0131k g\u00f6sterir. Emekli maa\u015f\u0131 ba\u011flanmas\u0131 i\u00e7in \u00f6nemli olan di\u011fer bir unsur ya\u015ft\u0131r.<\/p>\n<p>Emekli olmak i\u00e7in gerekli olan ya\u015f \u015fart\u0131 sigorta ba\u015flang\u0131\u00e7 tarihine g\u00f6re de\u011fi\u015fir. Bunun yan\u0131 s\u0131ra bir\u00e7ok kad\u0131n erken emeklilik \u015fartlar\u0131n\u0131n ne oldu\u011funu merak eder. Erkek ve <strong>kad\u0131nlarda erken emeklilik \u015fartlar\u0131 nelerdir<\/strong> sorusunun cevab\u0131 i\u00e7in iki farkl\u0131 imkandan bahsedebiliriz. Kad\u0131nlar i\u00e7in sigortal\u0131l\u0131k hizmeti sonras\u0131 s\u00fcredeki do\u011fumlar\u0131n\u0131 bor\u00e7lanabilirler. <strong>Bayanlarda erken emeklilik \u015fartlar\u0131<\/strong> kapsam\u0131nda \u00fc\u00e7 \u00e7ocuk i\u00e7in alt\u0131 y\u0131l yani 2160 g\u00fcn kazanma \u015fans\u0131 olur. <strong>Erken emeklilik \u015fartlar\u0131<\/strong> kapsam\u0131nda erkeklerde ise asker bor\u00e7lanma imkan\u0131 bulunur. Emeklilik ya\u015flar\u0131n\u0131n tespiti 5400 g\u00fcn\u00fc tamamlad\u0131klar\u0131 yada tamamlayacaklar\u0131 zamana g\u00f6re tespit edilir. Bu do\u011frultuda;<\/p>\n<ul>\n<li>12.2005 tarihine kadar 5400 prim g\u00fcn\u00fcn\u00fc tamamlayan kad\u0131nlar 61 ya\u015f\u0131nda emekli olmaya hak kazan\u0131rlar. Di\u011fer kad\u0131nlar ise;<\/li>\n<li>01.2036 ila 31.12.2037 tarihleri aras\u0131nda 5400 prim g\u00fcn\u00fcn\u00fc tamamlayan kad\u0131nlar 62&#8217;de,<\/li>\n<li>01.2038 ila 31.12.2039 tarihleri aras\u0131nda 5400 prim g\u00fcn\u00fcn\u00fc tamamlayan kad\u0131n 63&#8217;te,<\/li>\n<li>01.2040 ila 31.12. 2039 tarihleri aras\u0131nda 5400 prim g\u00fcn\u00fcn\u00fc tamamlayan kad\u0131n 64&#8217;te,<\/li>\n<li>01.2042 tarihinden itibaren ise 65 ya\u015f\u0131nda emeklili\u011fe hak kazan\u0131rlar.<\/li>\n<\/ul>\n<h2><strong>Malulen emeklilik \u015fartlar\u0131<\/strong><\/h2>\n<p><strong>Malulen emeklilik \u015fartlar\u0131<\/strong> kapsam\u0131nda i\u015f kazas\u0131 veya meslek hastal\u0131\u011f\u0131 nedeniyle engelli olan ki\u015filerin sa\u011fl\u0131k kurulu\u015flar\u0131na gitmeleri ve uzman doktorlar taraf\u0131ndan heyet raporu almalar\u0131 gerekir. Malulen emeklili\u011fi i\u00e7in en \u00f6nemli \u015fartlardan biri olan bir meslekte \u00e7al\u0131\u015famama oran\u0131d\u0131r. Malulen emeklili\u011fe hak kazanmak i\u00e7in, mesle\u011fin %60 veya daha fazla i\u015f g\u00f6remezlik oran\u0131na sahip olmas\u0131 gerekir. Ayr\u0131ca sosyal g\u00fcvenlik kurumu malul emeklili\u011finin bir di\u011fer \u015fart\u0131 en az 10 y\u0131l \u00e7al\u0131\u015fm\u0131\u015f olmak ve 1.800 g\u00fcn sigorta priminin \u00f6denmi\u015f olmas\u0131d\u0131r. Bu kural, engelli bir ki\u015finin ba\u015fka bir ki\u015finin bak\u0131m\u0131na ihtiyac\u0131 varsa de\u011fi\u015fir. Engelli bir ki\u015finin ba\u015fkalar\u0131ndan bak\u0131ma ihtiyac\u0131 varsa, 10 y\u0131ll\u0131k \u00e7al\u0131\u015fma s\u00fcresi say\u0131lmaz, ancak 1.800 g\u00fcn prim \u00f6denmesi gerekir.<\/p>\n<h2><strong>Engelli emeklilik \u015fartlar\u0131<\/strong><\/h2>\n<p>Engelli olan ki\u015filer \u00e7al\u0131\u015f\u0131rken \u00e7al\u0131\u015fma s\u00fcresi boyunca psikolojik sorunlar, fiziksel zorluklar ile beraber m\u00fccadele ederler. Bu y\u00fczden engelli olan ki\u015filere, di\u011fer ki\u015filere g\u00f6re daha erken emekli olma hakk\u0131 tan\u0131nm\u0131\u015ft\u0131r. Engelli olan ki\u015filerin i\u015f hayat\u0131ndaki y\u0131pranma s\u00fcre\u00e7leri de dikkate al\u0131narak b\u00f6yle bir d\u00fczenleme yap\u0131lm\u0131\u015ft\u0131r. Engelli emeklilik \u015fartlar\u0131 kapsam\u0131nda \u00f6ncelikle ki\u015filerin tam te\u015fekk\u00fcll\u00fc bir hastaneden engelli raporu almas\u0131 \u00f6nemlidir. <strong>Engelli emeklilik \u015fartlar\u0131<\/strong> kapsam\u0131nda 3 kriter \u00f6n plana \u00e7\u0131kar:<\/p>\n<ul>\n<li>Sigorta s\u00fcresi<\/li>\n<li>Engelli raporu en az %40<\/li>\n<li>Prim g\u00fcn say\u0131s\u0131<\/li>\n<\/ul>\n<p>Ki\u015fi engel raporunu ald\u0131ktan sonra t\u00fcm \u015fartlar\u0131 ta\u015f\u0131mas\u0131 ile birlikte erken emeklili\u011fe hak kazanm\u0131\u015f olur. Engelli olan ki\u015filer bu \u015fartlar\u0131 sa\u011flad\u0131ktan sonra ne zaman engellilikten emekli olabileceklerini de sorgulayabilirler. \u00dclkemizde erken emeklilik 5510 say\u0131l\u0131 kanun maddeleri kapsam\u0131nda d\u00fczenlenmi\u015ftir. Y\u00f6netmeli\u011fe g\u00f6re erken emeklilik \u015fartlar\u0131ndan yararlanmak isteyen ki\u015filer \u00f6ncelikle hastaneden engelli raporu almal\u0131lar. B\u00f6ylelikle engelli oldu\u011funu yasal olarak ispatlam\u0131\u015f olur. 28 Eyl\u00fcl 2021 tarihli resmi y\u00f6netmeli\u011fine g\u00f6re;<\/p>\n<ul>\n<li>%40 49 aras\u0131 hafif d\u00fczeyde \u00e7al\u0131\u015fma g\u00fcc\u00fcn\u00fc kaybetmi\u015f olanlar<\/li>\n<li>%50 59&#8217;a orta d\u00fczeyde \u00e7al\u0131\u015fma g\u00fcc\u00fcn\u00fc kaybetmi\u015f olanlar<\/li>\n<li>En az %60 oran\u0131nda olanlar a\u011f\u0131r d\u00fczeyde \u00e7al\u0131\u015fma g\u00fcc\u00fcn\u00fc kaybetmi\u015f olanlar olarak tan\u0131mlanm\u0131\u015ft\u0131r.<\/li>\n<\/ul>\n<p>Y\u00f6netmelik kapsam\u0131nda belirlenen orta, hafif ve a\u011f\u0131r derecelerde \u00e7al\u0131\u015fma g\u00fcc\u00fcn\u00fc kaybeden ki\u015filerin \u00e7al\u0131\u015fma g\u00fcc\u00fc kay\u0131p oran\u0131 tespiti i\u00e7in hastal\u0131k listeleri bulunur. Engelli emeklili\u011fi kapsam\u0131nda engelli rapor oran\u0131 %40 olarak belirlenmi\u015ftir. %40&#8217;tan daha az oranda engelli raporu olan ki\u015filer erken engelli emeklili\u011finden faydalanamazlar.
