Bu yasal d\u00fczenleme, dezavantajl\u0131 gruplar\u0131n \u00e7al\u0131\u015fma hayat\u0131na kat\u0131l\u0131m\u0131n\u0131 g\u00fcvence alt\u0131na alarak sosyal adaleti g\u00fc\u00e7lendirmeyi hedefler.<\/p>\n<h2>Engelli \u0130stihdam Kotas\u0131 Nas\u0131l Hesaplan\u0131r?<\/h2>\n<p>Yasal kota zorunlulu\u011fu, ayn\u0131 il s\u0131n\u0131rlar\u0131 i\u00e7erisinde faaliyet g\u00f6steren i\u015f yerlerindeki toplam \u00e7al\u0131\u015fan say\u0131s\u0131 \u00fczerinden hesaplanmaktad\u0131r. 2026 y\u0131l\u0131 itibar\u0131yla y\u00fcr\u00fcrl\u00fckte olan oranlar \u015fu \u015fekildedir:<\/p>\n<ul>\n<li><strong>\u00d6zel Sekt\u00f6r:<\/strong> 50 veya daha fazla \u00e7al\u0131\u015fan\u0131 bulunan \u00f6zel sekt\u00f6r i\u015f yerlerinde, toplam \u00e7al\u0131\u015fan say\u0131s\u0131n\u0131n en az %3&#8217;\u00fc oran\u0131nda engelli personel \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131 zorunludur.<\/li>\n<li><strong>Kamu Kurumlar\u0131:<\/strong> 50 veya daha fazla \u00e7al\u0131\u015fan\u0131 olan kamu i\u015f yerlerinde bu oran %4 engelli ve ilave olarak %2 eski h\u00fck\u00fcml\u00fc (veya TMY) olarak uygulan\u0131r.<\/li>\n<\/ul>\n<p><strong>Hesaplama Kural\u0131:<\/strong> \u0130lgili oranlar hesaplan\u0131rken yar\u0131mdan az olan kesirler dikkate al\u0131nmaz, yar\u0131m ve daha fazla olan kesirler ise tama yuvarlan\u0131r. \u00d6rne\u011fin; toplam 50 \u00e7al\u0131\u015fan\u0131 bulunan bir \u00f6zel \u015firket i\u00e7in hesaplama (50 x 0.03 = 1.5) \u015feklinde yap\u0131l\u0131r ve sonu\u00e7 tama yuvarlanarak 2 engelli personelin istihdam edilmesi gerekti\u011fi bulunur.<\/p>\n<h2>2026 Y\u0131l\u0131 Engelli Personel \u00c7al\u0131\u015ft\u0131rmama Cezas\u0131 Ne Kadar?<\/h2>\n<p>Yasal kontenjan\u0131 doldurmayan i\u015fverenler i\u00e7in, her ay ve \u00e7al\u0131\u015ft\u0131r\u0131lmayan her bir engelli kontenjan\u0131 ba\u015f\u0131na idari para cezas\u0131 tahakkuk ettirilir. <strong>2026 y\u0131l\u0131 g\u00fcncel mevzuat verilerine g\u00f6re bu idari para cezas\u0131, \u00e7al\u0131\u015ft\u0131r\u0131lmayan her engelli birey ve her ay i\u00e7in 37.749 TL olarak uygulanmaktad\u0131r.<\/strong> Yasal kotan\u0131n bir y\u0131l boyunca bo\u015f b\u0131rak\u0131lmas\u0131, i\u015fletmeler i\u00e7in y\u00fcz binlerce liray\u0131 bulan ciddi mali riskler olu\u015fturmaktad\u0131r.<\/p>\n<h2>Engelli \u0130stihdam\u0131nda SGK Te\u015fvikleri Nelerdir?<\/h2>\n<div>\n<p>Mevzuata uygun \u015fekilde engelli istihdam eden i\u015fverenler i\u00e7in maliyet avantaj\u0131 sa\u011flayan devlet destekleri mevcuttur. <strong>Kontenjan dahilinde veya kontenjan fazlas\u0131 olarak \u00e7al\u0131\u015ft\u0131r\u0131lan engelli personelin, prime esas kazan\u00e7 \u00fczerinden hesaplanan malull\u00fck, ya\u015fl\u0131l\u0131k ve \u00f6l\u00fcm sigortalar\u0131na ait SGK i\u015fveren hissesi Hazine taraf\u0131ndan kar\u015f\u0131lanmaktad\u0131r.<\/strong><\/p>\n<p>&#x1f4cc;
