K\u0131dem tazminat\u0131 ise\u00a0ko\u015fullar\u0131 olu\u015fursa i\u015f s\u00f6zle\u015fmesi sona eren i\u015f\u00e7iye\u00a0i\u015fveren taraf\u0131ndan \u00f6denmesi gereken tazminat\u00a0anlam\u0131na geliyor. Avukat Ozan Bar\u0131\u015f Demir\u00a0tazminatlarla ilgili g\u00fcndemdeki son de\u011fi\u015fiklikleri ve\u00a0merak edilenleri payla\u015f\u0131yor.<\/p>\n<h2><strong>K\u0131dem tazminat\u0131 fonu g\u00fcndemde<\/strong><\/h2>\n<p>K\u0131dem ve ihbar tazminat\u0131 aras\u0131ndaki en \u00f6nemli\u00a0fark\u0131n ihbar tazminat\u0131n\u0131n hem i\u015f\u00e7i hem de i\u015fveren\u00a0taraf\u0131ndan sorumluluk y\u00fckleyen bir tazminat,\u00a0k\u0131dem tazminat\u0131n\u0131n ise sadece i\u015fverene sorumluluk\u00a0y\u00fckleyen bir tazminat \u00e7e\u015fidi oldu\u011funu belirten\u00a0Demir, her iki tazminat t\u00fcr\u00fcn\u00fcn de birbirinden\u00a0ba\u011f\u0131ms\u0131z oldu\u011funu vurguluyor. K\u0131dem tazminat\u0131<br \/>\n\u00f6demek zorunda olmayan i\u015fveren taraf\u0131ndan ihbar\u00a0tazminat\u0131 \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc do\u011fabildi\u011fi gibi,\u00a0yasaya uygun olarak ihbar s\u00fcrelerine uyan i\u015fveren\u00a0taraf\u0131ndan sadece k\u0131dem tazminat\u0131 \u00f6denerek de\u00a0i\u015f akdinin feshedilebildi\u011fini ifade eden Demir,\u00a0yasan\u0131n son durumundan da bahsediyor. Bug\u00fcn,\u00a0\u00f6zellikle 2015 se\u00e7imleri d\u00f6neminde ad\u0131ndan \u00e7ok\u00e7a\u00a0s\u00f6z ettiren K\u0131dem Tazminat\u0131 Fonu\u2019nun g\u00fcndemde\u00a0oldu\u011funu s\u00f6yleyen Demir, bu sistemin gerek\u00a0hukuki gerekse \u00e7al\u0131\u015fma hayat\u0131 bak\u0131m\u0131ndan temel\u00a0bir de\u011fi\u015fim \u00f6ng\u00f6rd\u00fc\u011f\u00fcn\u00fcn alt\u0131n\u0131 \u00e7iziyor. Bu geli\u015fmeye\u00a0ra\u011fmen hen\u00fcz k\u0131dem tazminat\u0131nda bir de\u011fi\u015fiklik\u00a0yok, \u0130\u015f Kanunu\u2019nda yer alan s\u00fcrelere riayet edilerek\u00a0i\u015f\u00e7inin k\u0131dem tazminat\u0131 hesaplan\u0131yor. \u0130hbar\u00a0tazminat\u0131 bak\u0131m\u0131ndan ise son d\u00f6nemde g\u00fcncel\u00a0bir \u00e7al\u0131\u015fma yok, bildirimli fesihte i\u015f\u00e7i veya i\u015fveren\u00a0taraf\u0131n\u0131n \u0130\u015f Kanunu\u2019nda belirtilen asgari s\u00fcrelere\u00a0uyma zorunlulu\u011fu var\u201d diyor.<\/p>\n<h2><strong>Tazminatlarla ilgili detaylar\u0131n\u00a0bilinmesi \u00e7ok kritik<\/strong><\/h2>\n<p>\u0130\u015f s\u00f6zle\u015fmesinin devam etti\u011fi s\u00fcre\u00e7te at\u0131lan\u00a0ad\u0131mlar\u0131n olduk\u00e7a \u00f6nemli oldu\u011funu vurgulayan\u00a0Demir, \u201cS\u00f6zle\u015fmenin ba\u015flang\u0131\u00e7 ve biti\u015finde\u00a0yasal bildirimlerin do\u011fru yap\u0131lm\u0131\u015f olmas\u0131, SGK\u00a0kay\u0131tlar\u0131n\u0131n do\u011fru tutulmas\u0131 \u00e7ok \u00f6nemli. Bu\u00a0bildirimler tazminat konulu bir davada \u00f6nemli\u00a0deliller aras\u0131nda yer al\u0131yor. \u0130nsan Kaynaklar\u0131\u00a0uzmanlar\u0131n\u0131n t\u00fcm tazminat t\u00fcrlerini ve hangi\u00a0durumda hak edilebilirlik durumunun ortaya\u00a0\u00e7\u0131kt\u0131\u011f\u0131n\u0131 iyi bilmeleri gerekiyor. Bir fesih hakl\u0131\u00a0nedene dayans\u0131n ya da dayanmas\u0131n, \u0130nsan\u00a0Kaynaklar\u0131 uzmanlar\u0131n\u0131n fesihte do\u011fru y\u00f6ntemi\u00a0izlemesi ve \u0130\u015f Kanunu ve Yarg\u0131tay\u2019\u0131n arad\u0131\u011f\u0131 \u015fartlara\u00a0uyarak feshi ger\u00e7ekle\u015ftirmesi hak kay\u0131plar\u0131n\u0131n\u00a0\u00f6n\u00fcne ge\u00e7ilmesi a\u00e7\u0131s\u0131ndan \u00f6nemli. \u00d6rne\u011fin\u00a0olay\u0131n \u015fartlar\u0131na g\u00f6re savunmas\u0131 al\u0131nmadan ya\u00a0da \u015fahitlerle somut olay ispatlanmadan yap\u0131lan\u00a0kimi fesihler i\u015fveren aleyhine sonu\u00e7lanabilir\u201d diye<br \/>\nkonu\u015fuyor.<\/p>\n<h2><strong>Yanl\u0131\u015f bilgiler hak kay\u0131plar\u0131na\u00a0yol a\u00e7\u0131yor<\/strong><\/h2>\n<p>\u0130\u015f Kanunu\u2019nun a\u00e7\u0131k bir anlat\u0131mla t\u00fcm i\u015f\u00e7i-i\u015fveren\u00a0fesih ve tazminat t\u00fcrlerini belirlemi\u015f somut bir\u00a0kanun olup \u00e7er\u00e7evesinin \u00e7izilmi\u015f oldu\u011funu belirten\u00a0Demir, buna ra\u011fmen yanl\u0131\u015f bilginin s\u0131kl\u0131kla hak\u00a0kayb\u0131na neden oldu\u011funu s\u00f6yl\u00fcyor. Demir, en\u00a0s\u0131k kar\u015f\u0131la\u015f\u0131lan yanl\u0131\u015f bilginin istifa eden i\u015f\u00e7inin\u00a0tazminat alamayaca\u011f\u0131 bilgisi oldu\u011funu s\u00f6yl\u00fcyor.<br \/>\nDemir, \u201cUnutulmamal\u0131 ki, k\u0131dem tazminat\u0131\u00a0bir hediye ya da l\u00fctuf de\u011fil, anayasal dayana\u011f\u0131\u00a0olan bir hak. \u0130\u015f\u00e7ilerin \u00fccretlerini eksik almas\u0131\u00a0veya zaman\u0131nda almamas\u0131, genel tatil, prim\u00a0gibi uygulamalar\u0131n i\u015fveren taraf\u0131ndan i\u015f\u00e7iye\u00a0sa\u011flanmamas\u0131\u00a0kanunen hakl\u0131\u00a0bir neden olarak\u00a0g\u00f6r\u00fcl\u00fcyor. Bir i\u015f\u00e7iye\u00a0ald\u0131\u011f\u0131 \u00fccret \u00fczerinden\u00a0sigorta primi\u00a0\u00f6denmemesi i\u015f\u00e7iye\u00a0o i\u015f s\u00f6zle\u015fmesin\u00a0hakl\u0131 nedenle fesih\u00a0hakk\u0131 veriyor. \u0130\u015f\u00e7i;\u00a0askerlik hizmeti,\u00a0sa\u011fl\u0131k problemleri ve\u00a0evlilik gibi nedenlerle,\u00a0aranan di\u011fer \u015fartlar\u00a0da olu\u015ftuysa k\u0131dem\u00a0tazminat\u0131na hak\u00a0kazan\u0131yor\u201d \u015feklinde\u00a0a\u00e7\u0131klama yap\u0131yor. \u0130\u015fveren taraf\u0131ndan her i\u015ften\u00a0\u00e7\u0131kar\u0131lan i\u015f\u00e7inin mutlaka tazminat almaya hak\u00a0kazand\u0131\u011f\u0131n\u0131n d\u00fc\u015f\u00fcn\u00fclmesinin de ola\u011fan yanl\u0131\u015f\u00a0bilgilerden oldu\u011funu s\u00f6yleyen Demir, i\u015fveren\u00a0taraf\u0131ndan i\u015f akdinin feshi hakl\u0131 bir nedene\u00a0dayan\u0131yorsa kanunda belirtilen hakl\u0131 fesih\u00a0nedenlerinin i\u015f\u00e7iye tazminat \u00f6denmemesi karar\u0131na\u00a0neden olabildi\u011fini s\u00f6yl\u00fcyor.<\/p>\n<h2><strong>Tazminat davalar\u0131 s\u0131kl\u0131kla \u00e7al\u0131\u015fan\u0131n\u00a0lehine sonu\u00e7lan\u0131yor<\/strong><\/h2>\n<p>\u0130\u015f Kanunu\u2019nun i\u015f\u00e7iyi koruma amac\u0131 g\u00fcden bir\u00a0kanun oldu\u011funu belirten Demir, \u0130\u015f Kanunu\u2019na\u00a0ili\u015fkin yapt\u0131r\u0131mlarda bu nedenle i\u015f\u00e7inin eme\u011finin\u00a0g\u00fcvence alt\u0131na al\u0131nmas\u0131n\u0131n hedefl endi\u011fini\u00a0vurguluyor. Tazminata ili\u015fkin i\u015f davalar\u0131n\u0131n\u00a0e\u011fer gerekli \u015fartlar olu\u015fmu\u015fsa genel olarak\u00a0i\u015f\u00e7inin lehine sonu\u00e7land\u0131\u011f\u0131n\u0131 s\u00f6yleyen Demir,\u00a0\u201cYarg\u0131lama sonundaki as\u0131l sorun yarg\u0131n\u0131n\u00a0h\u00fckmetti\u011fi tazminatlar\u0131n i\u015fverenden al\u0131nabilir\u00a0olup olmad\u0131\u011f\u0131. \u0130\u015fverenin \u00f6deme g\u00fcc\u00fc, \u00f6zellikle\u00a0\u015firketlerin son d\u00f6nemde \u00e7ok h\u0131zl\u0131 iflas\u0131 g\u00f6z \u00f6n\u00fcnde\u00a0bulunduruldu\u011funda zorla\u015fabiliyor. Bu a\u00e7\u0131dan\u00a0i\u015f\u00e7inin yarg\u0131 kar\u015f\u0131s\u0131nda tazminata hak kazanmas\u0131\u00a0yetmiyor, tahsil kabiliyetinin de iyi olmas\u0131\u00a0gerekiyor\u201d diye konu\u015fuyor.<\/p>\n<h2><strong>Yarg\u0131n\u0131n i\u015fleyi\u015fi iyile\u015ftirilmeli<\/strong><\/h2>\n<p>Tasar\u0131 halindeki K\u0131dem Tazminat\u0131 Fonu\u2019nun\u00a0faydal\u0131 olabilmesi i\u00e7in g\u00fc\u00e7l\u00fc temellerle i\u015f\u00e7iden\u00a0yana tutum sergilemek gerekti\u011fini belirten Demir,\u00a0as\u0131l iyile\u015ftirmenin yarg\u0131n\u0131n i\u015fleyi\u015fiyle ilgili olmas\u0131\u00a0gerekti\u011fini belirtiyor. Demir, \u201cYarg\u0131 sisteminde\u00a0yap\u0131lacak kal\u0131c\u0131 ve sa\u011flam reformlar \u00f6zellikle\u00a0i\u015f\u00e7ilerin tazminatlar\u0131na h\u0131zl\u0131 ula\u015fabilmesinin\u00a0\u00f6n\u00fcn\u00fc a\u00e7acak olup i\u015fverenlerin de belirsiz bir s\u00fcre\u00a0ile davalarla kar\u015f\u0131 kar\u015f\u0131ya kalmalar\u0131n\u0131n \u00f6n\u00fcne\u00a0ge\u00e7ecektir. Di\u011fer bir de\u011fi\u015fiklik ise arabuluculuk\u00a0sistemi ile geldi.
