Otomatik BES uygulamas\u0131n\u0131 getiren y\u00fcr\u00fcrl\u00fck, 1 Ocak 2017&#8217;de ba\u015flayacak. Kanun, \u00e7al\u0131\u015fan\u0131n bordrosundaki maa\u015f\u0131 kar\u015f\u0131l\u0131\u011f\u0131 zorunlu kesinti yap\u0131larak tasarrufa y\u00f6nlendirilmesi amac\u0131yla cinsiyet fark\u0131 ve i\u015f kolu g\u00f6zetilmeksizin 45 ya\u015f alt\u0131 b\u00fct\u00fcn \u00e7al\u0131\u015fanlar\u0131 kapsayacak. Ancak \u00e7al\u0131\u015fanlar cayma hakk\u0131n\u0131 da kullanabilecek. Sosyal G\u00fcvenlik Uzman\u0131 O\u011fuz Asl\u0131m, yasa ile ilgili \u015firketlerin ve \u0130K profesyonellerinin dikkat etmesi gereken ad\u0131mlar\u0131 anlat\u0131yor.<\/p>\n<h2>Birikim yapmay\u0131 sa\u011fl\u0131yor<\/h2>\n<p>O\u011fuz Asl\u0131m, yasan\u0131n \u00e7al\u0131\u015fanlara hem avantajlar\u0131n\u0131n hem de dezavantajlar\u0131n\u0131n oldu\u011fu belirterek s\u00f6zlerine ba\u015fl\u0131yor. BES sisteminin birikim yapmaya yard\u0131mc\u0131 oldu\u011funu s\u00f6yleyen Asl\u0131m, \u201c\u00c7al\u0131\u015fanlar\u0131n birikimleri y\u00fczde 25 devlet katk\u0131 pay\u0131 ile desteklenir, yani yapm\u0131\u015f oldu\u011funuz her katk\u0131 pay\u0131 i\u00e7in y\u00fczde 25 devlet katk\u0131s\u0131 elde edersiniz, devlet katk\u0131s\u0131 limiti, ayl\u0131k br\u00fct asgari \u00fccretinin y\u00fczde 25\u2019i kadar. Ayr\u0131ca BES fonunuzu ve \u015firketinizi de\u011fi\u015ftirme hakk\u0131n\u0131z var, herhangi bir \u00fccret \u00f6demeden ba\u015fka bir \u015firkete ge\u00e7i\u015f yapabilirsiniz ve fonlar\u0131n\u0131z\u0131 istedi\u011finiz zaman kontrol edebilirsiniz\u201d diyor. BES \u00f6demelerinin \u00e7al\u0131\u015fan\u0131n b\u00fct\u00e7esi do\u011frultusunda azalt\u0131labilece\u011fini ya da dondurulabilece\u011fini dile getiren Asl\u0131m, BES fonlar\u0131n\u0131n vergiden muaf oldu\u011funu s\u00f6yl\u00fcyor. BES\u2019ten 10 y\u0131l doldurmadan \u00e7\u0131k\u0131lmas\u0131 halinde\u00a0devletin ciddi miktarda kesinti yapt\u0131\u011f\u0131n\u0131, bu nedenle \u00e7al\u0131\u015fanlar\u0131n zor durumda kalmalar\u0131 durumunda dahi sistemden \u00e7\u0131kmamalar\u0131 gerekti\u011fini vurgulayan Asl\u0131m, BES\u2019in di\u011fer dezavantajlar\u0131n\u0131 \u015f\u00f6yle s\u0131ral\u0131yor: \u201cBES\u2019te fonlar\u0131n iyi y\u00f6netilmemesi durumunda \u00e7al\u0131\u015fanlar istedikleri oranda gelir elde edemeyebilir. Bunun yan\u0131 s\u0131ra BES \u015firketleri y\u00f6netim kesintileri yapar. Bu kesintilerin oran\u0131 genellikle y\u00fczde 8-10 aral\u0131\u011f\u0131nda yer al\u0131r.\u201d<\/p>\n<h2>\u00c7al\u0131\u015fan iki ay i\u00e7inde cayabilecek<\/h2>\n<p>\u00c7al\u0131\u015fanlar\u0131n, emeklilik plan\u0131na dahil oldu\u011funun kendilerine bildirildi\u011fi tarihten itibaren iki ay i\u00e7inde s\u00f6zle\u015fmeden cayabilece\u011fini kaydeden Asl\u0131m, \u201cCayma halinde, \u00f6denen katk\u0131 paylar\u0131, varsa hesab\u0131nda bulunan yat\u0131r\u0131m gelirleri ile birlikte 10 i\u015f g\u00fcn\u00fc i\u00e7inde \u00e7al\u0131\u015fana iade edilecek. BES \u015firketi, cayma s\u00fcresince \u00f6denen katk\u0131 paylar\u0131n\u0131n de\u011fer kaybetmemesini sa\u011flayacak \u015fekilde fon y\u00f6netiminden sorumlu olacak\u201d diye konu\u015fuyor. Asl\u0131m, cayma hakk\u0131n\u0131 kullanmayan \u00e7al\u0131\u015fan\u0131n ise belirlenecek hallerde katk\u0131 pay\u0131 \u00f6demesine ara verilmesini talep edebilece\u011fini anlat\u0131yor.<\/p>\n<h2>Yasa t\u00fcm i\u015fverenleri kaps\u0131yor<\/h2>\n<p>Asl\u0131m, \u00e7al\u0131\u015fan say\u0131s\u0131 belirtilmeksizin b\u00fct\u00fcn i\u015fverenlerin 6740 say\u0131l\u0131 BES kanununa g\u00f6re \u00e7al\u0131\u015fanlar\u0131n\u0131, BES sisteminde de\u011ferlendirmekle ve yasal y\u00fck\u00fcml\u00fcl\u00fckleri uygulamakla mecbur oldu\u011funu vurguluyor. \u201c\u00c7al\u0131\u015fan katk\u0131 pay\u0131, i\u015fverenin taraf oldu\u011fu 9.6.1932 tarihli ve 2004 say\u0131l\u0131 \u0130cra ve \u0130flas Kanunu kapsam\u0131ndaki haciz ve iflas yoluyla takip bak\u0131m\u0131ndan i\u015f\u00e7i alaca\u011f\u0131 niteli\u011finde imtiyazl\u0131 bir alacakt\u0131r\u201d diyen Asl\u0131m, \u201c\u0130\u015fverenler bu madde kapsam\u0131ndaki y\u00fck\u00fcml\u00fcl\u00fckleri bak\u0131m\u0131ndan \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131\u2019nca denetlenir. \u0130\u015fverenin bu madde kapsam\u0131ndaki y\u00fck\u00fcml\u00fcl\u00fcklerine ve bu madde uyar\u0131nca y\u00fcr\u00fcrl\u00fc\u011fe konulan d\u00fczenlemelere uymamas\u0131 halinde, her bir ihlal i\u00e7in \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131\u2019nca idari para cezas\u0131 uygulan\u0131r\u201d a\u00e7\u0131klamas\u0131n\u0131 yap\u0131yor. Uygulaman\u0131n \u00e7al\u0131\u015fan\u0131n bilgisi dahilinde yap\u0131laca\u011f\u0131n\u0131n alt\u0131n\u0131 \u00e7izen Asl\u0131m, \u015f\u00f6yle devam ediyor: \u201c\u0130K departmanlar\u0131 \u00f6ncelikle BES sistemi gere\u011fince bordro d\u00fczenlenmesi a\u015famas\u0131nda kanunun emretti\u011fi \u015fekilde \u00e7al\u0131\u015fmalar\u0131 y\u00fcr\u00fctecek. \u00c7al\u0131\u015fan\u0131n onay\u0131n\u0131\u00a0ve gerekli belgeleri \u00f6zl\u00fck dosyas\u0131na koyup, gerekli bakanl\u0131klara evraklar\u0131 hem yaz\u0131l\u0131 olarak hem de internet ortam\u0131ndan bildirecek. Ard\u0131ndan da \u00e7al\u0131\u015fan ad\u0131na yap\u0131lan kesintilerini BES hissedar\u0131 ad\u0131na ilgili BES \u015firketi hesab\u0131na \u00f6deyecek.\u201d BES\u2019e uyum sa\u011flamak i\u00e7in olu\u015fturulan ana hatlar\u0131n belli oldu\u011funu, yasaya entegre konusunda ilgili bakanl\u0131klar\u0131n kendi aralar\u0131nda koordine \u00e7al\u0131\u015fma yapt\u0131\u011f\u0131n\u0131 ifade eden Asl\u0131m, \u015firketlerin ve \u0130K departmanlar\u0131n\u0131n kanunun uygulamas\u0131nda zorluk \u00e7ekmeyece\u011fini belirtiyor.<\/p>\n<h2>\u0130\u015fveren nelere dikkat etmeli?<\/h2>\n<p>Asl\u0131m, i\u015fverenin \u00e7al\u0131\u015fan\u0131n\u0131, emeklilik plan\u0131 d\u00fczenleme konusunda Hazine M\u00fcste\u015farl\u0131\u011f\u0131\u2019nca uygun g\u00f6r\u00fclen bir \u015firketin sunaca\u011f\u0131 emeklilik plan\u0131na dahil edebilece\u011fini s\u00f6yl\u00fcyor ve bu tutar\u0131n en ge\u00e7 \u00e7al\u0131\u015fan\u0131n \u00fccretinin \u00f6deme g\u00fcn\u00fcn\u00fc takip eden i\u015f g\u00fcn\u00fc i\u015fveren taraf\u0131ndan \u015firkete aktar\u0131laca\u011f\u0131n\u0131 vurguluyor. \u201c\u0130\u015fveren katk\u0131 pay\u0131n\u0131 zaman\u0131nda \u015firkete aktarmaz veya ge\u00e7 aktar\u0131rsa, \u00e7al\u0131\u015fan\u0131n birikiminde olu\u015fan parasal kay\u0131ptan sorumlu olacak\u201d diye konu\u015fan Asl\u0131m, s\u00f6zlerini \u015f\u00f6yle noktal\u0131yor: \u201c\u00c7al\u0131\u015fan, otomatik kat\u0131l\u0131ma ili\u015fkin emeklilik s\u00f6zle\u015fmesinde belirlenen tutardan daha y\u00fcksek bir tutarda kesinti yap\u0131lmas\u0131n\u0131 i\u015fverenden talep edebilecek. Buradan da anla\u015f\u0131laca\u011f\u0131 gibi i\u015fverenlerin kasas\u0131ndan bir \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc yok, fakat \u00e7al\u0131\u015fanlar\u0131n \u00fccretlerini anla\u015fma esas\u0131na g\u00f6re s\u00fcresinde \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc i\u015fverene gizli sorumluluk y\u00fckl\u00fcyor. Tahsilat zorlu\u011fu \u00e7eken, ifl as erteleme ya da icra takibinde olan \u015firketlerin bu y\u00fck\u00fcml\u00fcl\u00fckte taahh\u00fcd\u00fc baz\u0131 s\u0131k\u0131nt\u0131lara sebebiyet verebilir.
