Emeklilik ya\u015f\u0131 \u00fclkeden \u00fclkeye de\u011fi\u015fiklik g\u00f6sterdi\u011fi gibi bug\u00fcn bir\u00e7ok \u00fclkede de kad\u0131nlar erkeklere g\u00f6re daha erken ya\u015fta emekli olabiliyor. Uzmanlar emeklilik ya\u015f\u0131 ve emeklilik maa\u015f\u0131n\u0131n hesaplamalar\u0131nda ve takibinde \u0130nsan Kaynaklar\u0131 uzmanlar\u0131 kadar \u00e7al\u0131\u015fanlara da g\u00f6rev d\u00fc\u015ft\u00fc\u011f\u00fcn\u00fc belirtiyor. Emeklilik mevzuat\u0131ndaki son geli\u015fmeler nedir? \u0130nsan Kaynaklar\u0131 uzmanlar\u0131n\u0131n nelere dikkat etmesi gerekiyor? Emeklilikle ilgili do\u011fru bilinen yanl\u0131\u015flar neler? \u0130\u015f ve Sosyal G\u00fcvenlik Uzman\u0131 \u00d6zg\u00fcr Kaya mevzuatla ilgili dikkat etmesi gereken ad\u0131mlar\u0131 anlat\u0131yor.<\/p>\n<h2><strong>Emeklilik ya\u015f\u0131 65 oldu<\/strong><\/h2>\n<p>\u0130\u015f ve Sosyal G\u00fcvenlik Uzman\u0131 \u00d6zg\u00fcr Kaya, T\u00fcrkiye\u2019de emeklilik ya\u015f\u0131n\u0131n devlet taraf\u0131ndan farkl\u0131 stat\u00fclere ve farkl\u0131 ko\u015fullara g\u00f6re kanunla belirlendi\u011fini ifade ediyor. Kaya, \u201c8 Eyl\u00fcl 1999 tarihine kadar kad\u0131nlar 38, erkekler ise 43 ya\u015f\u0131nda emekli olabiliyorlard\u0131. O tarihten sonra emeklilik \u015fartlar\u0131 de\u011fi\u015ftirildi. Emekli olabilme ya\u015f\u0131 ve prim<br \/>\n\u00f6deme g\u00fcn say\u0131s\u0131 y\u00fckseltildi. Kademeli olarak y\u00fckseltilen emeklilik ya\u015f\u0131 ve prim \u00f6deme g\u00fcn say\u0131s\u0131 1 Ocak 2048 tarihi itibariyle 65 olarak uygulanacak\u201d diyor. Farkl\u0131 durumlar i\u00e7in farkl\u0131 emeklilik ya\u015flar\u0131 bulundu\u011funu s\u00f6yleyen Kaya, ki\u015finin durumuna \u00f6zel olan emeklilik ya\u015f\u0131n\u0131n ve prim \u00f6deme g\u00fcn say\u0131s\u0131n\u0131n emeklilik hesaplama cetveli yard\u0131m\u0131yla tespit edilebildi\u011fine dikkat \u00e7ekiyor.<\/p>\n<h2><strong>Kad\u0131n ve erkekler i\u00e7in farkl\u0131 prim g\u00fcn say\u0131s\u0131<\/strong><\/h2>\n<p>Kaya, \u201cEmeklilikte prim g\u00fcn say\u0131s\u0131, sosyal g\u00fcvenlik sistemine dahil olup emeklilik i\u00e7in prim \u00f6denmeye ba\u015flanan g\u00fcne g\u00f6re belirleniyor\u201d diyor ve kad\u0131n ile erkekler i\u00e7in doldurulmas\u0131 gereken prim g\u00fcn say\u0131lar\u0131n\u0131n farkl\u0131 oldu\u011funu dile getiriyor. Kaya, 1 Ekim 2008 tarihinden itibaren 5510 Sayl\u0131 Sosyal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131 Kanunu\u2019nun<br \/>\nuyguland\u0131\u011f\u0131n\u0131 anlat\u0131yor. Bu kanunla \u00f6zellikle kad\u0131n \u00e7al\u0131\u015fanlar\u0131n \u00e7al\u0131\u015fma hayat\u0131ndaki istihdam oranlar\u0131n\u0131n art\u0131r\u0131lmas\u0131 ve te\u015fvik edilmesi y\u00f6n\u00fcnde d\u00fczenlemeler yap\u0131ld\u0131\u011f\u0131na dikkat \u00e7eken Kaya, \u201cBu iki d\u00fczenlemeden birincisi kad\u0131nlara y\u00f6nelik bir uygulama olan do\u011fum bor\u00e7lanmas\u0131. Bu kapsamda, sigortal\u0131 olarak \u00e7al\u0131\u015fmaya ba\u015flad\u0131ktan sonra ger\u00e7ekle\u015fen do\u011fumlar\u0131n, iki do\u011fuma kadar olan toplam bin 440 g\u00fcnl\u00fck bor\u00e7lanma imkan\u0131na, \u00fc\u00e7\u00fcnc\u00fc do\u011fumun da ilave edilmesiyle toplam bor\u00e7lanma g\u00fcn say\u0131s\u0131n\u0131n iki bin 160 g\u00fcne \u00e7\u0131kar\u0131ld\u0131&#8221; diye konu\u015fuyor. Kaya, ikinci d\u00fczenlemenin de yine kad\u0131n \u00e7al\u0131\u015fanlara y\u00f6nelik olarak yap\u0131ld\u0131\u011f\u0131n\u0131 kaydediyor. Buna g\u00f6re engelli \u00e7ocu\u011fu bulunan \u00e7al\u0131\u015fan annelerin sigortal\u0131l\u0131k s\u00fcrelerine fiili hizmet zamm\u0131n\u0131n uyguland\u0131\u011f\u0131n\u0131 vurgulayan Kaya \u015f\u00f6yle devam ediyor: \u201cKad\u0131n \u00e7al\u0131\u015fan\u0131n, engelli \u00e7ocu\u011fu bulanan annenin bir y\u0131ll\u0131k \u00e7al\u0131\u015fmas\u0131na 90 g\u00fcn ilave ediliyor. Bir ba\u015fka ifade ile 360 g\u00fcnl\u00fck \u00e7al\u0131\u015fmas\u0131na 90 g\u00fcn ilave edilir ve \u00e7al\u0131\u015fmas\u0131 bir y\u0131l kar\u015f\u0131l\u0131\u011f\u0131nda 450 g\u00fcn olarak say\u0131l\u0131r. Bu 90 g\u00fcnl\u00fck ilave g\u00fcn say\u0131s\u0131 da emeklilik ya\u015f\u0131ndan d\u00fc\u015f\u00fcr\u00fcl\u00fcr. Engelli \u00e7ocu\u011fu bulunan \u00e7al\u0131\u015fan annelerin bu haktan yararlanabilmesi i\u00e7in engelli \u00e7ocuklar\u0131 i\u00e7in verilmi\u015f olan sa\u011fl\u0131k raporunu mutlaka Sosyal G\u00fcvenlik Kurumu\u2019na ibraz etmeleri gerekiyor.\u201d<\/p>\n<h2><strong>Primleri kontrol etmek \u00f6nem ta\u015f\u0131yor<\/strong><\/h2>\n<p>Kaya, \u00e7al\u0131\u015fanlar\u0131n emeklilik i\u00e7in dikkat etmeleri gereken en \u00f6nemli hususun ise emekli olduktan\u00a0sonra alacaklar\u0131 emekli maa\u015f\u0131 oldu\u011funa dikkat \u00e7ekiyor. Kaya, \u201cEmekli maa\u015flar\u0131, \u00e7al\u0131\u015fanlar\u0131n \u00e7al\u0131\u015fm\u0131\u015f oldu\u011fu y\u0131llar\u0131n ve \u00f6denmi\u015f olan primlerin toplamlar\u0131 \u00fczerinden yap\u0131laca\u011f\u0131 i\u00e7in, \u00e7al\u0131\u015fanlar\u0131n adlar\u0131na \u00f6denen primlerin ger\u00e7ek \u00fccret \u00fczerinden \u00f6denip \u00f6denmedi\u011fine dikkat etmeleri gerekiyor\u201d diyor. Kaya, \u00e7al\u0131\u015fanlar\u0131n i\u015fverenleri taraf\u0131ndan kendilerine \u00f6denen \u00fccretler \u00fczerinden primlerinin yat\u0131r\u0131l\u0131p yat\u0131r\u0131lmad\u0131\u011f\u0131n\u0131 kontrol etmemeleri durumunda emekli olduklar\u0131nda \u015fok ya\u015fayabileceklerini anlat\u0131yor. Kaya, b\u00f6ylesi bir durumda \u00e7al\u0131\u015fanlar\u0131n alacaklar\u0131 maa\u015flar\u0131n bug\u00fcnk\u00fc emekli ayl\u0131\u011f\u0131 ba\u011flama sistemine g\u00f6re d\u00fc\u015f\u00fck olabilece\u011fini s\u00f6yleyerek \u00e7al\u0131\u015fanlar\u0131 uyar\u0131yor. Kaya bu nedenle \u0130nsan Kaynaklar\u0131 uzmanlar\u0131n\u0131n da \u00e7al\u0131\u015fanlar\u0131n sigorta primlerinin d\u00fczenli ve ger\u00e7ek \u00fccretler \u00fczerinden \u00f6denmesi gerekti\u011fini belirtiyor.<\/p>\n<h2><strong>Do\u011fru bilinen yanl\u0131\u015flar var<\/strong><\/h2>\n<p>Kaya, \u0130nsan Kaynaklar\u0131 departmanlar\u0131n\u0131n do\u011fru bildi\u011fi yanl\u0131\u015flar\u0131n oldu\u011funu dile getiriyor. Kaya, Sosyal G\u00fcvenlik mevzuat\u0131na g\u00f6re, \u00e7al\u0131\u015fanlar\u0131n emeklilik i\u00e7in gerekli olan \u015fartlar\u0131 yerine getirmeleri halinde kuruma yaz\u0131l\u0131 m\u00fcracaat ederek emekli olduklar\u0131n\u0131 ve ayl\u0131klar\u0131n\u0131n ba\u011fland\u0131\u011f\u0131n\u0131 s\u00f6yl\u00fcyor. Ancak uygulamada emekli olduktan sonra \u00e7al\u0131\u015fmaya devam edecek \u00e7al\u0131\u015fanlar i\u00e7in \u0130K departmanlar\u0131n\u0131n s\u0131kl\u0131kla yapt\u0131\u011f\u0131 iki hatan\u0131n oldu\u011funu dile getiren Kaya, \u201c\u00c7al\u0131\u015fanlar emeklilik \u015fartlar\u0131n\u0131 yerine getirdikleri halde \u00e7al\u0131\u015fanlara bu hakk\u0131n kulland\u0131r\u0131lmad\u0131\u011f\u0131n\u0131, \u2018Emekli olursan\u0131z i\u015f akdiniz sona erer\u2019, mant\u0131\u011f\u0131ndan yola \u00e7\u0131karak hatal\u0131 bir uygulama yap\u0131ld\u0131\u011f\u0131n\u0131 g\u00f6r\u00fcyoruz. Oysa \u00e7al\u0131\u015fanlar emekli olduktan sonra \u00e7al\u0131\u015ft\u0131klar\u0131, kurumun kendileri ile \u00e7al\u0131\u015fma arzusunda ise, i\u015f akdi sonland\u0131r\u0131lmadan da sigortal\u0131l\u0131k stat\u00fcs\u00fc de\u011fi\u015ftirilerek \u00e7al\u0131\u015fmay\u0131 s\u00fcrd\u00fcrebilir\u201d diyor. Kaya, yap\u0131lan ikinci hatay\u0131 ise \u015fu \u015fekilde a\u00e7\u0131kl\u0131yor: \u201cEmekli olan bir \u00e7al\u0131\u015fan i\u015f akdi sona ermeden \u00e7al\u0131\u015fmaya devam etti\u011fi halde, bu \u00e7al\u0131\u015fan\u0131n i\u015f akdi sonland\u0131r\u0131ld\u0131\u011f\u0131nda k\u0131dem tazminat\u0131, emekli oldu\u011fu y\u0131ldaki br\u00fct \u00fccret \u00fczerinden hesaplan\u0131yor. Oysa k\u0131dem tazminat\u0131 \u00f6demesinde \u00e7al\u0131\u015fan\u0131n aktif sigortal\u0131 ya da pasif sigortal\u0131 olmas\u0131n\u0131n bir anlam\u0131 yok.
