Y\u0131ll\u0131k izinler konusunda i\u015fverenler ve \u00e7al\u0131\u015fanlar aras\u0131ndaki ayr\u0131l\u0131klar\u0131 engellemek amac\u0131yla yap\u0131ld\u0131\u011f\u0131 belirtilen yasal d\u00fczenlemenin ayr\u0131nt\u0131lar\u0131nda dikkat edilmesi gereken noktalar bulunuyor. \u00c7\u0131kar\u0131lan yasan\u0131n i\u015f hayat\u0131nda yarataca\u011f\u0131 sonu\u00e7lar hakk\u0131nda bilgi veren \u0130\u015f ve Sosyal G\u00fcvenlik M\u00fc\u015faviri \u015eakir G\u00fclsever, \u0130K uzmanlar\u0131n\u0131n konuyla ilgili bilgilerinin de artmas\u0131 gerekti\u011fini ifade ediyor. G\u00fclsever\u2019den ger\u00e7ekle\u015ftirilen torba yasa de\u011fi\u015fikli\u011fini ve bu de\u011fi\u015fikli\u011fin sonu\u00e7lar\u0131n\u0131 \u00f6\u011frendik.<\/p>\n<h2>\u0130\u015f\u00e7i ve i\u015fveren aras\u0131ndaki tart\u0131\u015fmalar \u00f6nlenecek<\/h2>\n<p>G\u00fclsever \u00f6ncelikle, 6704 say\u0131l\u0131 Torba Yasa ile 4857 Say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 56. maddesinde de\u011fi\u015fiklik yap\u0131ld\u0131\u011f\u0131n\u0131 ve b\u00f6ylece izin s\u00fcrelerinin, taraflar\u0131n anla\u015fmas\u0131 ile bir b\u00f6l\u00fcm\u00fc on g\u00fcnden a\u015fa\u011f\u0131 olmamak \u00fczere b\u00f6l\u00fcmler halinde kullan\u0131labilecek \u015fekilde bir d\u00fczenlemenin yap\u0131ld\u0131\u011f\u0131n\u0131 bildiriyor. G\u00fclsever, \u201c4857 say\u0131l\u0131 \u0130\u015f Kanunu ve Y\u0131ll\u0131k izin Y\u00f6netmeli\u011fi ile personelin \u00e7al\u0131\u015fma s\u00fcresi esas al\u0131narak y\u0131ll\u0131k izin hakk\u0131 yasal alt s\u0131n\u0131r 14 g\u00fcn-20 g\u00fcn ve 26 g\u00fcn olarak kullan\u0131m\u0131 belirlendi. Yasa gere\u011fince hafta tatili ve ulusal bayram g\u00fcnlerine rastlayan g\u00fcnler y\u0131ll\u0131k izin g\u00fcnlerinden say\u0131lm\u0131yor\u201d diye bilgi veriyor. Bundan \u00f6nceki d\u00fczenlemeler hakk\u0131nda da bilgi veren G\u00fclsever, daha \u00f6nce y\u0131ll\u0131k izin y\u00f6netmeli\u011finin bir b\u00f6l\u00fcm\u00fc 10 g\u00fcnden a\u015fa\u011f\u0131 olmamak \u00fczere en fazla \u00fc\u00e7e b\u00f6l\u00fcnerek personele kulland\u0131r\u0131ld\u0131\u011f\u0131n\u0131 belirtiyor. Ancak \u00e7al\u0131\u015fanlar\u0131n istekleri ve ihtiya\u00e7lar\u0131 nedeniyle \u015firketlerin zorunlu olarak g\u00fcnl\u00fck izin kulland\u0131rtt\u0131\u011f\u0131n\u0131 fakat bu durumun da idari para cezas\u0131na neden oldu\u011funu a\u00e7\u0131kl\u0131yor. Son d\u00f6nemde \u00c7al\u0131\u015fma Bakanl\u0131\u011f\u0131 denetimlerinde birer g\u00fcn izin kulland\u0131r\u0131lmas\u0131 nedeniyle \u015firketlere \u00f6nemli cezalar kesildi\u011fini hat\u0131rlatan G\u00fclsever, \u201cKi\u015fi baz\u0131nda kesilen 285TL tutar\u0131ndaki idari para cezalar\u0131n\u0131n artmas\u0131 i\u015f\u00e7i-i\u015fveren aras\u0131ndaki tart\u0131\u015fmalar\u0131n yo\u011funla\u015fmas\u0131na neden oldu\u201d diyor.<\/p>\n<h2>Yeni d\u00fczen daha fazla zarar verebilir<\/h2>\n<p>G\u00fclsever, yeni d\u00fczenleme sonras\u0131nda y\u0131ll\u0131k izin haklar\u0131n\u0131n ilk izinde 10 g\u00fcn ve kalan k\u0131s\u0131mda ilk be\u015f y\u0131lda 4 g\u00fcn par\u00e7al\u0131 olarak kulland\u0131r\u0131ld\u0131\u011f\u0131n\u0131, 20 g\u00fcn izni olanlar i\u00e7in ise 10 g\u00fcn temel ve 10 g\u00fcn de i\u015f\u00e7inin iste\u011fine ba\u011fl\u0131 olarak kullan\u0131m durumunun ortaya \u00e7\u0131kt\u0131\u011f\u0131n\u0131 kaydediyor. Bu durumun i\u015fyerlerinin \u00e7al\u0131\u015fma d\u00fczenine \u00f6nemli etkiler b\u0131rakaca\u011f\u0131n\u0131 vurgulayan G\u00fclsever, Y\u0131ll\u0131k izin kullan\u0131m\u0131 ile ilgili yap\u0131lan bu de\u011fi\u015fikliklerin i\u015fyerlerindeki i\u015f s\u00fcre\u00e7lerini olumsuz etkileyece\u011fini belirtiyor. G\u00fclsever, \u201cY\u0131ll\u0131k izin kullan\u0131mlar\u0131n\u0131n i\u015fverenin y\u00f6netim hakk\u0131 gere\u011fince y\u0131ll\u0131k izin planlar\u0131 yap\u0131larak kulland\u0131r\u0131lmas\u0131 esas\u0131n\u0131n i\u015fveren nezdinde bozulmas\u0131 ve daha fazla i\u015fletmesel sorunlar\u0131 getirmesi bekleniyor. Torba Yasa ile yap\u0131lan de\u011fi\u015fiklik \u00e7al\u0131\u015fma hayat\u0131na daha fazla zarar verecektir. Asl\u0131nda burada yap\u0131lmas\u0131 gereken par\u00e7al\u0131 izin kulland\u0131r\u0131lmas\u0131 halinde kesilen idari para cezas\u0131 ile ilgili maddenin kald\u0131r\u0131lmas\u0131yla \u00e7\u00f6z\u00fclebilirdi. \u0130\u015f\u00e7i- i\u015fveren aras\u0131ndaki anla\u015fma ile bu durum zaten \u00e7\u00f6z\u00fclecektir\u201d diyor.<\/p>\n<h2>Y\u0131ll\u0131k izinler kesinlikle hak edildi\u011fi y\u0131l kulland\u0131r\u0131lmal\u0131<\/h2>\n<p>\u0130nsan Kaynaklar\u0131 uzmanlar\u0131n\u0131n izin haklar\u0131n\u0131n kulland\u0131r\u0131lmas\u0131 konusundaki uygulama bilgilerinin\u00a0\u00e7ok yetersiz kald\u0131\u011f\u0131n\u0131 savunan G\u00fclsever, bu nedenle \u00e7al\u0131\u015fanlar ve \u0130K uzmanlar\u0131 aras\u0131nda bilgi eksikli\u011finden ve \u015firketlerde izin planlamas\u0131 yap\u0131lmamas\u0131ndan kaynakl\u0131 tart\u0131\u015fmalar ya\u015fand\u0131\u011f\u0131n\u0131 ifade ediyor. \u00c7al\u0131\u015fanlar\u0131n izin haklar\u0131n\u0131n hak edildi\u011fi y\u0131l kulland\u0131r\u0131lmas\u0131n\u0131n \u00f6nemine de\u011finen G\u00fclsever, bir\u00e7ok i\u015fletmede biriken \u00e7ok fazla izin oldu\u011funa dikkat \u00e7ekiyor. G\u00fclsever ayr\u0131ca, \u201cBaz\u0131 \u015firketlerde biriken y\u0131ll\u0131k izinler ikinci k\u0131dem tazminat\u0131 gibi de\u011ferlendiriliyor. Y\u0131ll\u0131k izinler i\u015fverenin y\u00f6netim hakk\u0131 gere\u011fince i\u015fveren taraf\u0131ndan planlanarak zaman\u0131nda kulland\u0131r\u0131lmal\u0131. Ancak izin kullanma d\u00f6nemlerinde i\u015fveren i\u015f\u00e7inin isteklerine de elden geldi\u011fi kadar de\u011fer vermeli\u201d diye belirtiyor.<\/p>\n<h2>2014 y\u0131l\u0131 sonras\u0131 izinler i\u00e7in acil \u00f6nlem al\u0131nmal\u0131<\/h2>\n<p>Bu konuda ya\u015fanacak aksakl\u0131klar sonucu i\u015f\u00e7i ve i\u015fverenlerin \u00f6nemli kay\u0131plar ya\u015fama ihtimalinin olduk\u00e7a y\u00fcksek oldu\u011funu dile getiren G\u00fclsever, bu konuda \u00f6nemli bir bilgiyi daha payla\u015f\u0131yor. G\u00fclsever,\u201c \u0130\u015fletmelere tavsiyem 2014 y\u0131l\u0131ndan sonraki izinlerin kullan\u0131m\u0131 i\u00e7in acil tedbir almalar\u0131 ve bundan sonraki izinleri zaman\u0131nda kulland\u0131r\u0131lmalar\u0131 ve belgelendirmeleri. Y\u0131ll\u0131k izinler ile ilgili yak\u0131n zamanda bu tart\u0131\u015fmalara son verecek de\u011fi\u015fiklikler yap\u0131ld\u0131 ve bunlar yak\u0131n zamanda i\u015f kanununun ilgili maddelerine ilave edilecektir.
