Buna g\u00f6re bir kazan\u0131n i\u015f kazas\u0131 say\u0131labilmesi i\u00e7in; kazaya u\u011frayan\u0131n sigortal\u0131 olmas\u0131, olay\u0131n 5510 say\u0131l\u0131 kanunun 13. maddesinde belirtilen hallerden birinde meydana gelmesi, sigortal\u0131n\u0131n kaza nedeniyle hemen veya sonras\u0131nda zarara u\u011fram\u0131\u015f olmas\u0131, zarar ile kaza aras\u0131nda illiyet ba\u011f\u0131 olmas\u0131 gerekmektedir. Ayr\u0131ca, sigortal\u0131n\u0131n i\u015fyerinde bulundu\u011fu s\u0131rada, i\u015fveren taraf\u0131ndan y\u00fcr\u00fct\u00fclmekte olan i\u015f dolay\u0131s\u0131yla, sigortal\u0131n\u0131n i\u015fveren taraf\u0131ndan g\u00f6revle ba\u015fka bir yere g\u00f6nderilmesi y\u00fcz\u00fcnden as\u0131l i\u015fini yapmaks\u0131z\u0131n ge\u00e7en zamanlarda, emzikli kad\u0131n sigortal\u0131n\u0131n \u00e7ocu\u011funa s\u00fct vermek i\u00e7in ayr\u0131lan zamanlarda ve sigortal\u0131lar\u0131n i\u015fverence sa\u011flanan bir ta\u015f\u0131tla i\u015fin yap\u0131ld\u0131\u011f\u0131 yere toplu olarak g\u00f6t\u00fcr\u00fcl\u00fcp getirilmeleri s\u0131ras\u0131nda meydana gelen ve sigortal\u0131 \u00e7al\u0131\u015fan\u0131 bedenen ya da ruhen \u00f6zre u\u011fratan olaylar i\u015f kazas\u0131d\u0131r.<\/p>\n<p>\u0130\u015f kazas\u0131,\u00a0yabanc\u0131 ve d\u0131\u015ftan gelen bir etken yani, d\u0131\u015f bir olay sonucu ma\u011fdurun v\u00fccut b\u00fct\u00fcnl\u00fc\u011f\u00fcne, organik yap\u0131s\u0131na zarar vermelidir. D\u0131\u015ftan gelen olay; i\u015f yerinde patlama, bir maddenin \u00e7arpmas\u0131, d\u00fc\u015fmesi, zehirlenme, elektrik cereyan\u0131na kap\u0131lma, y\u00fcksekten d\u00fc\u015fme, g\u00fcne\u015f \u00e7arpmas\u0131 gibi durumlar olabilir. Kasti olmasa dahi bir i\u015f ifas\u0131 s\u0131ras\u0131nda meydana gelebilecek durumlar, zaman \u00e7evre ikileminde i\u015f kazas\u0131na sebebiyet ilkeleri olarak kabul edilmektedir.<\/p>\n<h2><strong>\u0130\u015f kazas\u0131 sonras\u0131nda ne yap\u0131lmas\u0131 gerekiyor?<\/strong><\/h2>\n<p>\u0130\u015fveren taraf\u0131ndan, kolluk kuvvetlerine derhal ve Sosyal G\u00fcvenlik Kurumu\u2019na da en ge\u00e7 kazadan sonraki \u00fc\u00e7 i\u015f g\u00fcn\u00fc i\u00e7inde bildirilmesi zorunludur. Ancak, bu s\u00fcre i\u015f kazas\u0131n\u0131n i\u015fverenin kontrol\u00fc d\u0131\u015f\u0131ndaki yerlerde meydana gelmesi halinde, i\u015f kazas\u0131n\u0131n \u00f6\u011frenildi\u011fi tarihten itibaren ba\u015flar.\u00a0Bildirim i\u015fveren taraf\u0131ndan yap\u0131lmam\u0131\u015f ise kazal\u0131 i\u015f\u00e7i taraf\u0131ndan yerine getirilmelidir. Bildirim tarihine kadar ge\u00e7en s\u00fcre i\u00e7in sigortal\u0131ya \u00f6denecek ge\u00e7ici i\u015f g\u00f6remezlik \u00f6dene\u011fi, kurumca i\u015fverenden tahsil edilir. Ayr\u0131ca, i\u015f kazas\u0131 SGK\u2019ya eksik ya da yanl\u0131\u015f bildirilmi\u015fse, bu olay i\u00e7in yersiz olarak yap\u0131lm\u0131\u015f bulunan \u00f6demeler, \u00f6demenin yap\u0131ld\u0131\u011f\u0131 tarihten itibaren ger\u00e7e\u011fe ayk\u0131r\u0131 bildirimde bulunanlardan, i\u015fverenden ve illiyeti bulunanlardan yasal faizi ile birlikte tahsil edilir.<\/p>\n<h2><strong>\u00c7al\u0131\u015fan\u0131n bu s\u00fcre\u00e7te ne yapmas\u0131 gerekiyor?<\/strong><\/h2>\n<p>\u00c7al\u0131\u015fan\u0131n \u00f6ncelikle ya\u015fam hakk\u0131n\u0131 muhafaza etmesi i\u00e7in tedavi amac\u0131 esast\u0131r. \u0130\u015f kazas\u0131 oldu\u011fu i\u00e7in her t\u00fcrl\u00fc yasal hakk\u0131 baki kalmak \u015fart\u0131yla \u00e7al\u0131\u015fan\u0131n kendisi, yak\u0131nlar\u0131 ve taraf olan kurumlar arac\u0131l\u0131\u011f\u0131yla i\u015f kazas\u0131n\u0131n takibi yap\u0131l\u0131r. \u0130\u015f kazas\u0131na veya meslek hastal\u0131\u011f\u0131na u\u011frayan ki\u015finin sigortal\u0131 olmas\u0131 halinde 5510 say\u0131l\u0131 Sosyal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131 Kanunu uyar\u0131nca \u00e7al\u0131\u015fana gerekli sa\u011fl\u0131k yard\u0131mlar\u0131 yap\u0131l\u0131r. (madde 63) Yine bu i\u015f\u00e7iye, ge\u00e7ici ve s\u00fcrekli i\u015f g\u00f6remezlik \u00f6denekleri de ba\u011flan\u0131r. (Madde 18-19) \u00a0Ancak SGK, zarara u\u011frayan i\u015f\u00e7inin veya deste\u011finden yoksun kalanlar\u0131n manevi zararlar\u0131n\u0131 kar\u015f\u0131layacak herhangi bir \u00f6deme yapmaz. \u0130\u015f\u00e7i veya destekten yoksun kalan yak\u0131nlar\u0131, SGK taraf\u0131ndan kar\u015f\u0131lanmayan zararlar\u0131 i\u00e7in i\u015fverene ba\u015fvurma hakk\u0131na sahiptir. SGK, i\u015f\u00e7iye ve hak sahiplerine yapt\u0131\u011f\u0131 \u00f6demeleri, i\u015f\u00e7iyi g\u00f6zetme borcunu kusuruyla yerine getirmeyen i\u015fverene r\u00fccu edebilir. Bir di\u011fer yandan, 5510 Say\u0131l\u0131 Kanun\u2019dan do\u011fan haklar be\u015f y\u0131l i\u00e7inde zamana\u015f\u0131m\u0131na u\u011frar. Kanunun 97. maddesine g\u00f6re i\u015f kazalar\u0131 ve meslek hastal\u0131klar\u0131 nedeniyle hak kazan\u0131lan gelir ve ayl\u0131klar\u0131n, hakk\u0131n kazan\u0131ld\u0131\u011f\u0131 tarihten itibaren be\u015f y\u0131l i\u00e7inde istenmemesi halinde zamana\u015f\u0131m\u0131na u\u011frayaca\u011f\u0131 kurala ba\u011flanm\u0131\u015ft\u0131r. Buna kar\u015f\u0131l\u0131k i\u015fverenin g\u00f6zetme borcuna ayk\u0131r\u0131 davran\u0131\u015f\u0131ndan do\u011fan tazminat davas\u0131 i\u00e7in 10 y\u0131ll\u0131k zamana\u015f\u0131m\u0131 belirlenmi\u015ftir. Buna g\u00f6re, yasal s\u00fcre i\u00e7inde SGK\u2019ya ba\u015fvurmam\u0131\u015f i\u015f\u00e7i, t\u00fcm zararlar\u0131n\u0131 i\u015fverenden talep edebilecektir. Yarg\u0131tay, i\u015f\u00e7i veya hak sahiplerinin haklar\u0131n\u0131 almak i\u00e7in \u00f6ncelikle Sosyal G\u00fcvenlik Kurumu\u2019na ba\u015fvurmalar\u0131 ve mahkemenin tazminata h\u00fckmetmeden \u00f6nce bu ba\u015fvurunun sonucunun beklenilmesi gerekti\u011fi g\u00f6r\u00fc\u015f\u00fcndedir.<\/p>\n<h2><strong>\u0130\u015fveren hangi durumlarda sorumlu olur?<\/strong><\/h2>\n<p>\u0130\u015fverenin i\u015f kazas\u0131 nedeniyle tazmin sorumlulu\u011funun do\u011fmas\u0131 i\u00e7in her \u015feyden \u00f6nce bir kazan\u0131n olmas\u0131, bu kazan\u0131n bir i\u015f kazas\u0131 niteli\u011finde olmas\u0131, i\u015fverenin kusurlu olmas\u0131, i\u015f kazas\u0131 sonucunda bedensel veya ruhsal bir zarar\u0131n ya da \u00f6l\u00fcm\u00fcn ortaya \u00e7\u0131kmas\u0131 ve uygun illiyet ba\u011f\u0131n\u0131n bulunmas\u0131 gerekir. \u0130\u015fverenin g\u00f6zetme borcuna ayk\u0131r\u0131 davran\u0131\u015f\u0131 sonucunda meydana gelen i\u015f kazas\u0131 veya meslek hastal\u0131\u011f\u0131 nedeniyle i\u015f\u00e7i, u\u011frad\u0131\u011f\u0131 bedensel ya da ruhsal zararlar\u0131n\u0131n tazminini talep edebilir (Maddi tazminat) Bunun yan\u0131nda i\u015f\u00e7i, ko\u015fullar\u0131 varsa ayr\u0131ca manevi tazminat da isteyebilir. \u0130\u015fverenin g\u00f6zetme borcuna ayk\u0131r\u0131 davranmas\u0131 sonucunda, i\u015f kazas\u0131na u\u011frayan veya meslek hastal\u0131\u011f\u0131na tutulan i\u015f\u00e7inin \u00f6l\u00fcm\u00fc halinde deste\u011finden yoksun kalanlar da tazminat talebinde bulunabilirler. Buna \u201cdestekten yoksun kalma tazminat\u0131\u201d ad\u0131 verilir.<\/p>\n<p>Kazalardan dolay\u0131 i\u015fverenin sorumlulu\u011fu \u00fc\u00e7\u00a0halde s\u0131n\u0131rland\u0131r\u0131labilir:<\/p>\n<p><strong>M\u00fccbir sebep: <\/strong>Bu husus, sorumlunun faaliyet ve i\u015fletmesi d\u0131\u015f\u0131nda olu\u015fan kesin ve ka\u00e7\u0131n\u0131lmaz olarak olay\u0131n meydana gelmesini etkileyen o an i\u00e7in kar\u015f\u0131 konulmas\u0131 m\u00fcmk\u00fcn olmayan olaylard\u0131r.\u00a0\u0130\u015fverenin\u00a0olay\u0131n meydana gelmesinde veya sonu\u00e7lar\u0131n\u0131n azalt\u0131lmas\u0131nda bir kusurunun olmamas\u0131 esast\u0131r.<\/p>\n<p><strong>Zarar g\u00f6renin a\u011f\u0131r kusuru:<\/strong> Neden sonu\u00e7 ili\u015fkisinin kesilmesine \u00e7al\u0131\u015fan\u0131n kendi davran\u0131\u015f\u0131 sebep olmu\u015f ve\u00a0illiyet ba\u011f\u0131n\u0131\u00a0tam kesmi\u015f ise a\u011f\u0131r kusurdan s\u00f6z edilebilir. \u00c7al\u0131\u015fan i\u015fin ifas\u0131 s\u0131ras\u0131nda kendisinden beklenen en temel basit ve ola\u011fan \u00f6zeni g\u00f6stermemi\u015f ise onun bu davran\u0131\u015f\u0131\u00a0i\u015fverenin sorumlulu\u011funun\u00a0kalkmas\u0131na te\u015fkil eder. \u00c7al\u0131\u015fan\u0131n kusurlu davran\u0131\u015f\u0131n\u0131n\u00a0illiyet ba\u011f\u0131n\u0131\u00a0tam kesmedi\u011fi halde ise ortak neden-sonu\u00e7 ili\u015fkisinden bahsedilerek birlikte kusur ve tazminat indirimi bir olas\u0131l\u0131k olarak g\u00fcndeme gelebilir.<\/p>\n<p><strong>\u00dc\u00e7\u00fcnc\u00fc \u015fahs\u0131n a\u011f\u0131r kusuru:<\/strong> \u00dc\u00e7\u00fcnc\u00fc \u015fahs\u0131n a\u011f\u0131r kusuru neden-sonu\u00e7 ba\u011f\u0131n\u0131 kesebilecek yo\u011funlukta ise i\u015fverenin sorumlulu\u011fu kalkar. Zira bu durumda i\u015fverenin i\u015fletme tehlikelerine kar\u015f\u0131 \u00f6nlem alma borcu geri plana itilmekte ve \u00fc\u00e7\u00fcnc\u00fc \u015fahs\u0131n a\u011f\u0131r kusuru zarar\u0131 do\u011furan sebep olmaktad\u0131r.<\/p>\n<p>\u0130\u015f kazas\u0131 ge\u00e7irmi\u015f i\u015f\u00e7iler, kaza tarihinden \u00e7ok sonra, resmi kurumlara ya da hak arama aray\u0131\u015f\u0131na gidiyor. \u0130\u015f kazas\u0131 ge\u00e7iren i\u015f\u00e7iler \u00e7o\u011funlukla ayn\u0131 i\u015fyerinde \u00e7al\u0131\u015fmaya devam ediyor. \u0130\u015ften at\u0131lma korkusu nedeniyle hak aramaktan ka\u00e7\u0131n\u0131yor. \u0130\u015f kazas\u0131 ge\u00e7iren i\u015f\u00e7inin \u00f6ncelikle hastaneye resmi i\u015f kazas\u0131 kayd\u0131n\u0131n yapmas\u0131 gerekiyor. \u0130\u015fverenlerin ise i\u015f kazas\u0131 oldu\u011funu bildirmesi gerekiyor. \u00c7\u00fcnk\u00fc yasa, i\u015f kazas\u0131 olmas\u0131 durumunda hem i\u015f\u00e7iye hem de i\u015fverene i\u015f kazas\u0131n\u0131 bildirme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc getiriyor. \u0130\u015f\u00e7i i\u015finden at\u0131lma korkusuyla, k\u00f6t\u00fc niyetli i\u015fverenler ise \u201cnas\u0131l olsa olay \u00f6rtbas edilir\u201d d\u00fc\u015f\u00fcncesiyle bildirimde bulunmuyor. Bu nedenle bu t\u00fcr bir i\u015f kazas\u0131na u\u011frayanlar\u0131n ge\u00e7 ba\u015fvuruda bulunmalar\u0131 ve i\u015fverenlerin i\u015f kazas\u0131 bildiriminde bulunmamalar\u0131 bir sorun te\u015fkil ediyor.<\/p>\n<p>\u0130\u015f kazalar\u0131n\u0131 engelleyecek i\u015f g\u00fcvenli\u011fi tedbirleri al\u0131nm\u0131yor. \u00c7\u00fcnk\u00fc i\u015f g\u00fcvenli\u011finin bedelini ve sorumlusunun paras\u0131n\u0131 i\u015fveren \u00f6d\u00fcyor. Firman\u0131n eksikleri ve uygulamalar\u0131 ise denetlenmiyor.
