Ki\u015finin sayg\u0131s\u0131z ve zararl\u0131 bir davran\u0131\u015f\u0131n hedefi olmas\u0131yla ba\u015flay\u0131p; i\u015fverenin ima ve alay ile kar\u015f\u0131s\u0131ndakinin toplumsal itibar\u0131n\u0131 d\u00fc\u015f\u00fcrmeyi de i\u00e7eren sald\u0131rgan bir ortam yaratarak onu i\u015ften \u00e7\u0131kmaya zorlamas\u0131d\u0131r. Ya\u015f, cinsiyet, \u0131rk ayr\u0131m\u0131 olmaks\u0131z\u0131n ki\u015fiyi i\u015f ya\u015fam\u0131ndan d\u0131\u015flamak amac\u0131 ile kas\u0131tl\u0131 olarak yap\u0131l\u0131r.\u00a0 Mobbing uygulayan ki\u015fiye <em>\u201c<em>tacizci<\/em>\u201d,<\/em> mobbing\u2019e maruz kalan ki\u015fiye ise <em>\u201c<em>ma\u011fdur<\/em>\u201d<\/em> denir. Psikolojik \u015fiddet, bask\u0131, ku\u015fatma, taciz, rahats\u0131z etme veya s\u0131k\u0131nt\u0131 vermektir. T\u00fcrk Dil Kurumu, mobbing kavram\u0131n\u0131n kar\u015f\u0131l\u0131\u011f\u0131 olarak\u00a0 \u201cBezdiri\u201d kelimesini belirlemi\u015f ve bezdiriyi \u201c<em>\u0130\u015f yerlerinde, okullarda vb. topluluklar i\u00e7inde belirli bir ki\u015fiyi hedef al\u0131p, \u00e7al\u0131\u015fmalar\u0131n\u0131 sistemli bir bi\u00e7imde engelleyip huzursuz olmas\u0131na yol a\u00e7arak y\u0131ld\u0131rma, d\u0131\u015flama, g\u00f6zden d\u00fc\u015f\u00fcrme<\/em>\u201d olarak tan\u0131mlam\u0131\u015ft\u0131r.<\/p>\n<h2><strong>Mobbing durumunda hangi mercilere ba\u015fvurulmal\u0131?<\/strong><\/h2>\n<p>Mobbing&#8217;e maruz kalanlar \u00c7SGB, TBMM, Anayasa Mahkemesi, B\u0130MER, Alo 170, Kamu G\u00f6revlileri Etik Kurulu, Kamu Denet\u00e7ili\u011fi Kurumu, T\u00fcrkiye \u0130nsan Haklar\u0131 Kurumu ve \u0130l, \u0130l\u00e7e \u0130nsan Haklar\u0131 Kurullar\u0131&#8217;na ba\u015fvuru yapabilirler. Yap\u0131lan \u015fikayet sonucu mobbing yap\u0131ld\u0131\u011f\u0131n\u0131 kan\u0131tlamak i\u00e7in kamera kay\u0131tlar\u0131, e- mailler, kullan\u0131lan ila\u00e7 faturalar\u0131, verilen i\u015flerle ilgili belge ve \u00f6rnekler al\u0131narak delil olarak sunulabilir. \u00c7\u00fcnk\u00fc yarg\u0131ya intikal eden davalarda delil etkin bir yarg\u0131lama i\u00e7in \u00f6nemlidir. Kamu ve \u00f6zel sekt\u00f6r ay\u0131rt etmeksizin t\u00fcm \u00e7al\u0131\u015fanlar\u00a0\u015fikayet ve bilgi almak i\u00e7in 7 g\u00fcn 24 saat ALO 170 Hatt\u0131na ba\u015fvurabilirler.<\/p>\n<h2><strong>\u015eikayetlerin y\u00fczde 67\u2019si \u00f6zel sekt\u00f6rden<\/strong><\/h2>\n<p>\u00dclkemizde mobbing\u2019e ili\u015fkin veriler hen\u00fcz kapsaml\u0131 olarak tutulmuyor. Ancak son iki y\u0131lda ALO 170\u2019e yap\u0131lan ba\u015fvurular \u00fczerinden bir de\u011ferlendirme yapmak m\u00fcmk\u00fcn. T\u00fcrkiye\u2019de son iki y\u0131lda ALO 170\u2019e be\u015f bin 890 mobbing \u015fik\u00e2yeti yap\u0131l\u0131rken bu \u015fik\u00e2yetlerin a\u011f\u0131rl\u0131kl\u0131 olarak \u00f6zel sekt\u00f6rden geldi\u011fi g\u00f6r\u00fcl\u00fcyor. \u015eik\u00e2yetlerin y\u00fczde 67\u2019si \u00f6zel sekt\u00f6r \u00e7al\u0131\u015fanlar\u0131ndan, y\u00fczde 33\u2019\u00fc kamu sekt\u00f6r\u00fc \u00e7al\u0131\u015fanlar\u0131ndan olu\u015fuyor. Hem \u00f6zel sekt\u00f6rde hem kamuda mobbing \u015fik\u00e2yetlerinin cinsiyet bak\u0131m\u0131ndan ayn\u0131 seviyede oldu\u011fu, erkeklerin de kad\u0131nlar\u0131n da ayn\u0131 oranda mobbing\u2019e maruz kald\u0131\u011f\u0131 g\u00f6r\u00fcl\u00fcyor.<\/p>\n<h2><strong>Kamuda \u00f6\u011fretmen, \u00fcniversitelerde ise personel s\u0131k\u0131nt\u0131l\u0131<\/strong><\/h2>\n<p>ALO 170\u2019e gelen \u015fik\u00e2yetler i\u00e7erisinde kamu sekt\u00f6r\u00fc \u00f6zelinde \u00f6\u011fretmenlerin ve \u00fcniversite personelinin s\u0131k\u0131nt\u0131da oldu\u011fu g\u00f6r\u00fcl\u00fcyor. \u00d6zellikle Milli E\u011fitim Bakanl\u0131\u011f\u0131 ve \u00fcniversitelerden gelen \u015fik\u00e2yetler \u00f6n planda. \u00dcniversitelerde bu tip davran\u0131\u015flar\u0131n ya\u015fanmas\u0131 \u00f6zellikle yad\u0131rganacak bir durum. Ancak bu durum, mobbing\u2019in e\u011fitim d\u00fczeyi ile do\u011frudan ili\u015fkili olmad\u0131\u011f\u0131n\u0131 da bir bak\u0131ma ortaya koyuyor. \u00d6zel sekt\u00f6r i\u00e7erisinde sanayi sekt\u00f6r\u00fcnde \u00e7al\u0131\u015fanlar\u0131n daha s\u0131k mobbing\u2019e maruz kald\u0131klar\u0131n\u0131 istatistikler ortaya \u00e7\u0131kar\u0131yor. Meslek bak\u0131m\u0131ndan bir ayr\u0131m yap\u0131ld\u0131\u011f\u0131nda ise bankac\u0131lar\u0131n bu psikolojik tacize daha fazla u\u011frad\u0131klar\u0131n\u0131 yine ara\u015ft\u0131rma rakamlar\u0131 ortaya koyuyor. M\u00fcmk\u00fcn olmayan hedefler verilmesi, s\u00fcrekli \u015fube de\u011fi\u015ftirilmesi, uzun \u00e7al\u0131\u015fma saatleri ve a\u015f\u0131r\u0131 stres bankac\u0131lar\u0131n mobbing\u2019e u\u011frama s\u0131kl\u0131\u011f\u0131n\u0131 y\u00fckseltti\u011fi gibi sekt\u00f6rde \u00e7al\u0131\u015fmay\u0131 da daha zor hale getiriyor.<\/p>\n<h2><strong>Ama\u00e7 istifa ettirmek<\/strong><\/h2>\n<p>\u0130\u015fverenlerin \u00e7al\u0131\u015fanlar\u0131na mobbing uygulamas\u0131n\u0131n en \u00f6nemli nedeni, ki\u015fiyi istifaya zorlayarak ihbar ve k\u0131dem tazminat\u0131 \u00f6dememek. Ayr\u0131ca, \u00e7al\u0131\u015fanlar\u0131 bask\u0131 alt\u0131nda tutarak izin kullanmalar\u0131n\u0131 zorla\u015ft\u0131rmak, fazla mesai \u00f6demesi yapmamak da i\u015fverenlerin mobbing uygulama nedenleri aras\u0131nda yer al\u0131yor. \u00c7al\u0131\u015fan\u0131n ba\u015fka bir \u00e7al\u0131\u015fana mobbing uygulamas\u0131n\u0131n arkas\u0131nda ise \u00e7o\u011fu kez i\u015fverene daha yak\u0131n olabilmek ve performansa dayal\u0131 \u00f6demelerden daha fazla pay alabilmek yat\u0131yor. ALO 170\u2019e son iki y\u0131lda gelen \u015fik\u00e2yetlerin y\u00fczde 20\u2019sinde \u00e7al\u0131\u015fanlar, istifaya zorland\u0131klar\u0131n\u0131 bildiriyor. Hakaret, k\u00f6t\u00fc muamele, s\u00f6zl\u00fc taciz, iftira, cinsel taciz ve fiziksel \u015fiddet bu y\u00f6nde yap\u0131lan olumsuz davran\u0131\u015flar olarak g\u00f6z\u00fck\u00fcyor. Bunun yan\u0131nda i\u015fverenlerden kaynaklanan ve bahsetti\u011fimiz gibi k\u0131dem ve ihbar tazminat\u0131 \u00f6dememe amac\u0131 ta\u015f\u0131yan davran\u0131\u015flar ise istifaya zorlama, g\u00f6rev yeri de\u011fi\u015fikli\u011fi, s\u00fcrekli tutanak tutulmas\u0131 ve yasal haklar\u0131n kulland\u0131r\u0131lmamas\u0131 olarak \u015fekilleniyor. Mobbing\u2019in daha \u00e7ok bu nedenlerle uyguland\u0131\u011f\u0131n\u0131 s\u00f6ylemek de m\u00fcmk\u00fcn. Gelen \u015fik\u00e2yetlerin y\u00fczde 44\u2019\u00fc bu nedenleri i\u015faret ediyor. Yani i\u015fverenlerin amac\u0131n\u0131n tazminattan ka\u00e7arak i\u015f\u00e7i \u00e7\u0131karmak oldu\u011fu ve bu nedenle mobbing uygulayarak istifaya zorlamay\u0131 tercih ettiklerini s\u00f6ylemek m\u00fcmk\u00fcn. \u00c7al\u0131\u015fanlar a\u00e7\u0131s\u0131ndan daha k\u00f6t\u00fcs\u00fc ise mobbing\u2019e maruz kalan ve dayanamayarak istifa etmek zorunda kalanlar i\u015ften kendi istekleriyle ayr\u0131ld\u0131klar\u0131 i\u00e7in i\u015fsizlik sigortas\u0131ndan da yararlanam\u0131yor.,<\/p>\n<h2>Neler yap\u0131labilir?<\/h2>\n<p>Mobbing\u2019e u\u011frad\u0131\u011f\u0131 kan\u0131tlanan \u00e7al\u0131\u015fan i\u015f s\u00f6zle\u015fmesinin feshinden do\u011fan k\u0131dem, ihbar gibi b\u00fct\u00fcn tazminatlar\u0131n\u0131 alabilece\u011fi gibi, dava sonucunda manevi tazminata da hak kazanabiliyor. Ayr\u0131ca bunun yan\u0131nda i\u015fverenin e\u015fit davranma borcunu ihlal etti\u011fi gerek\u00e7esiyle y\u00fcksek miktarda tazminat \u00f6demesi sonucu da do\u011fabilir. Ancak mobbing davalar\u0131nda ki\u015filerin mobbinge u\u011frad\u0131klar\u0131n\u0131 kan\u0131tlamalar\u0131 olduk\u00e7a zor. Bu y\u00fczden mobbing\u2019e u\u011frayan \u00e7al\u0131\u015fanlar\u0131n bu durumu m\u00fcmk\u00fcn oldu\u011funca fazla delille ortaya koymas\u0131 gerekiyor. Yarg\u0131tay\u2019\u0131n bu tip davalarda daha \u00f6nce \u00f6nemli miktarlarda manevi tazminat \u00f6denmesine karar verdi\u011fi biliniyor. Dolay\u0131s\u0131yla i\u015fverenin bu nedenle bask\u0131 uygulamaya ba\u015flad\u0131\u011f\u0131 i\u015f\u00e7i bu durumu delillerle a\u00e7\u0131k\u00e7a ortaya koyabilirse k\u0131dem ve ihbar tazminatlar\u0131na hak kazanabilece\u011fi gibi bir de manevi tazminat alabiliyor.<\/p>\n<h2><strong>Mobbingin i\u015fverene ne t\u00fcr cezai yapt\u0131r\u0131m\u0131 bulunuyor?<\/strong><\/h2>\n<p>Mobbing idari de\u011fil adli bir su\u00e7tur. T\u00fcrk Ceza Kanunu\u2019nun 105. maddesinde &#8220;Bir kimseyi cinsel ama\u00e7l\u0131 olarak taciz eden ki\u015fi hakk\u0131nda ma\u011fdurun \u015fik\u00e2yeti \u00fczerine, \u00fc\u00e7 aydan iki y\u0131la kadar hapis cezas\u0131na veya adli para cezas\u0131na h\u00fckmolunur. Bu fiiller; hiyerar\u015fi, hizmet veya e\u011fitim\/\u00f6\u011fretim ili\u015fkisinden kaynaklanan n\u00fcfuzu k\u00f6t\u00fcye kullan\u0131lmak suretiyle ya da ayn\u0131 i\u015fyerinde \u00e7al\u0131\u015fman\u0131n sa\u011flad\u0131\u011f\u0131 kolayl\u0131ktan yararlan\u0131larak i\u015flendi\u011fi takdirde, yukar\u0131daki f\u0131kraya g\u00f6re verilecek ceza yar\u0131 oran\u0131nda art\u0131r\u0131l\u0131r. Bu fiil nedeniyle ma\u011fdur; i\u015fi b\u0131rakmak, okuldan veya ailesinden ayr\u0131lmak zorunda kalm\u0131\u015f ise verilecek ceza bir y\u0131ldan az olamaz.&#8221; Ayn\u0131 kanunun 109. maddesinde \u2019\u2019Bir kimseyi hukuka ayk\u0131r\u0131 olarak bir yere gitmek veya bir yerde kalmak h\u00fcrriyetinden yoksun b\u0131rakan ki\u015fiye, bir y\u0131ldan be\u015f y\u0131la kadar hapis cezas\u0131 verilir. Ki\u015fi; fiili i\u015flemek i\u00e7in veya i\u015fledi\u011fi s\u0131rada cebir, tehdit veya hile kullan\u0131rsa iki y\u0131ldan yedi y\u0131la kadar hapis cezas\u0131na h\u00fckmolunur. Bu su\u00e7un ki\u015finin yerine getirdi\u011fi kamu g\u00f6revi nedeniyle kamu g\u00f6revinin sa\u011flad\u0131\u011f\u0131 n\u00fcf\u00fbz k\u00f6t\u00fcye kullan\u0131lmak suretiyle i\u015flenmesi halinde yukar\u0131daki f\u0131kralara g\u00f6re verilecek ceza bir kat art\u0131r\u0131l\u0131r.\u2019\u2019 Bu cezalar\u0131n yan\u0131nda \u00e7al\u0131\u015fan\u0131n maddi ve manevi tazminat davas\u0131 haklar\u0131 sakl\u0131 kalmak kayd\u0131yla adli hakk\u0131n\u0131 aramas\u0131 yollar\u0131 sabittir.<\/p>\n<p>Kamuda \u00e7al\u0131\u015ft\u0131\u011f\u0131m d\u00f6nemde mobbing\u2019e maruz kalm\u0131\u015f biri olarak ac\u0131s\u0131n\u0131 h\u00e2l\u00e2\u00a0y\u00fcre\u011finde hisseden biriyim.
