Sosyal G\u00fcvenlik Uzman\u0131\u00a0O\u011fuz Asl\u0131m, \u201cKay\u0131t d\u0131\u015f\u0131 istihdamla m\u00fccadele konusunda son 17 y\u0131lda olduk\u00e7a yol kat edildi. Daha \u00f6nceki y\u0131llarda y\u00fczde 96\u2019larda olan bu oran, son on y\u0131l i\u00e7erisinde y\u00fczde 37\u2019lere kadar geriledi. Kay\u0131t d\u0131\u015f\u0131 istihdam\u0131n \u015firketler i\u00e7in \u00f6nemli yapt\u0131r\u0131mlar\u0131 bulunuyor\u201d diyor.<\/strong><\/p>\n<p>\u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131\u2019n\u0131n yapt\u0131\u011f\u0131 \u00e7al\u0131\u015fmalar sonucunda sigortas\u0131z i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rma oranlar\u0131nda \u00f6nemli bir yol kat edilmesine ra\u011fmen kay\u0131t d\u0131\u015f\u0131 istihdam oranlar\u0131 h\u00e2l\u00e2 olduk\u00e7a y\u00fcksek. Bakanl\u0131\u011f\u0131n verilerine g\u00f6re 2005 y\u0131l\u0131nda y\u00fczde 48 olan kay\u0131t d\u0131\u015f\u0131l\u0131k oran\u0131, yasal d\u00fczenlemeler ve artan denetimler sayesinde dokuz y\u0131lda y\u00fczde 37&#8217;ye geriledi. T\u00fcrkiye&#8217;de, hemen hemen her sekt\u00f6rde ya\u015fanan istihdamdaki kay\u0131t d\u0131\u015f\u0131l\u0131k \u00f6zellikle tar\u0131m, in\u015faat, hizmet sekt\u00f6r\u00fcnde ve ge\u00e7ici-mevsimlik i\u015flerde yo\u011funla\u015f\u0131yor. Sosyal G\u00fcvenlik Uzman\u0131\u00a0O\u011fuz Asl\u0131m, sigortas\u0131z i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rman\u0131n kurumsal firmalardan ziyade, \u00e7o\u011funlukla k\u00fc\u00e7\u00fck ve orta \u00f6l\u00e7ekli i\u015fletmelerde g\u00f6r\u00fcld\u00fc\u011f\u00fcn\u00fc s\u00f6yl\u00fcyor. T\u00fcrkiye\u2019de firmalar\u0131n \u201cOlay olsun sonra gerekeni yapar\u0131z d\u00fc\u015f\u00fcncesi\u201d ile hareket etti\u011fini dile getiren Asl\u0131m, \u201cSigortas\u0131z i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rman\u0131n yan\u0131 s\u0131ra baz\u0131 firmalar deneyimli \u00e7al\u0131\u015fanlar\u0131n \u00fccretlerini, asgari \u00fccret \u00fczerinden g\u00f6steriyor. Bu t\u00fcr yasal olmayan uygulamalar ise i\u015fletmelerde telafisi imkans\u0131z sonu\u00e7lara neden oluyor\u201d diyor.<\/p>\n<h2><strong>Deneme s\u00fcresinde de sigortas\u0131z \u00e7al\u0131\u015ft\u0131r\u0131lamaz <\/strong><\/h2>\n<p>Asl\u0131m, firmalar\u0131n \u00e7al\u0131\u015fan i\u015fe ba\u015flamadan \u00f6nce Sosyal G\u00fcvenlik Kurumu\u2019na (SGK) bildirim yapmas\u0131 gerekti\u011fini dile getirerek, \u201c\u0130\u015fletmeler bu bildirimi en az bir g\u00fcn \u00f6ncesinden yapmakla y\u00fck\u00fcml\u00fc. Sadece bal\u0131k\u00e7\u0131l\u0131k, tar\u0131m ve in\u015faat i\u015flerinde, di\u011fer devaml\u0131 i\u015fyerlerinin aksine i\u015f\u00e7inin i\u015f ba\u015f\u0131 yapt\u0131\u011f\u0131 g\u00fcn\u00fcn sonuna kadar SGK\u2019ya bildirim yapmas\u0131 gerekir\u201d diye konu\u015fuyor. Toplumda deneme s\u00fcresi boyunca i\u015f\u00e7inin sigortas\u0131z olarak \u00e7al\u0131\u015ft\u0131r\u0131labilece\u011fi gibi bir inanc\u0131n oldu\u011funu ancak bu d\u00fc\u015f\u00fcncenin tamamen yanl\u0131\u015f oldu\u011funu ifade eden Asl\u0131m, deneme s\u00fcresi de dahil olmak \u00fczere bir \u00e7al\u0131\u015fan\u0131n kesinlikle sigortas\u0131z \u00e7al\u0131\u015ft\u0131r\u0131lamayaca\u011f\u0131n\u0131 vurguluyor. Asl\u0131m, i\u015f\u00e7i ve i\u015fveren aras\u0131nda yap\u0131lan s\u00f6zle\u015fmeye istinaden, ilk otuz g\u00fcn i\u00e7erisinde, kar\u015f\u0131l\u0131kl\u0131 talepte bulunmadan, i\u015f akdini feshetme hakk\u0131n\u0131n oldu\u011funa dikkat \u00e7ekerek, \u201cBuna s\u00f6zle\u015fmede deneme s\u00fcresi denilmekte. Burada i\u015fverenin i\u015f\u00e7iyi \u00e7\u0131kartma hakk\u0131 oldu\u011fu gibi, i\u015f\u00e7inin de i\u015fverenle \u00e7al\u0131\u015fmama hakk\u0131 var\u201d a\u00e7\u0131klamas\u0131n\u0131 yap\u0131yor. Asl\u0131m, kay\u0131t d\u0131\u015f\u0131 istihdamla m\u00fccadele konusunda son 17 y\u0131lda T\u00fcrkiye\u2019nin olduk\u00e7a yol kat etti\u011fini s\u00f6yl\u00fcyor.\u00a0 \u201c\u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131 ile \u0130\u015eKUR gibi ilgili alt birimlerin koordineli ve titiz bir \u00e7al\u0131\u015fma y\u00fcr\u00fctmesi sonucu, daha \u00f6nceki y\u0131llarda y\u00fczde 96\u2019larda olan kay\u0131t d\u0131\u015f\u0131 \u00e7al\u0131\u015fan oran\u0131, son on y\u0131l i\u00e7erisinde y\u00fczde 37\u2019lere kadar geriledi\u201d diyen Asl\u0131m, bu oran\u0131n azalmas\u0131nda ve halk\u0131n bilin\u00e7lendirilmesinde, ileti\u015fim kanallar\u0131n\u0131n, SGK\u2019n\u0131n, ALO 170 ihbar servisinin ve sosyal devlet olma a\u015famas\u0131ndaki iyile\u015ftirmelerin etkili oldu\u011funu vurguluyor.<\/p>\n<h2><strong>\u0130\u015fverenlere uygulanan cezai yapt\u0131r\u0131mlar neler? <\/strong><\/h2>\n<p>Asl\u0131m, sigortas\u0131z i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fverenlere uygulanan cezai yapt\u0131r\u0131mlar\u0131 \u015f\u00f6yle s\u0131ral\u0131yor: \u201c\u0130lgili bildirge ve belgelerin s\u00fcresinde verilmemi\u015f olmas\u0131, denetmen veya m\u00fcfetti\u015f taraf\u0131ndan inceleme yap\u0131lmas\u0131 halinde kay\u0131t ge\u00e7ersizli\u011fi veya kay\u0131t ibraz etmeme nedeniyle idari para cezas\u0131; i\u015f\u00e7inin hastalanmas\u0131, i\u015f kazas\u0131 ge\u00e7irmesi veya meslek hastal\u0131\u011f\u0131na yakalanmas\u0131 halinde, SGK\u2019n\u0131n kar\u015f\u0131la\u015ft\u0131\u011f\u0131 maliyet bedelinin i\u015fverenden tahsil edilmesi; i\u015fverenin bir y\u0131l s\u00fcreyle te\u015fvikten yararland\u0131r\u0131lmamas\u0131; sigortas\u0131z \u00e7al\u0131\u015ft\u0131r\u0131lan s\u00fcreye ait sigorta primlerinin i\u015fverenden gecikme zamm\u0131 ve cezas\u0131 (faizi) ile birlikte tahsil edilmesi gibi ceza ve yapt\u0131r\u0131mlar uygulan\u0131yor.\u201d<\/p>\n<h2><strong>Sigortas\u0131z \u00e7al\u0131\u015fanlar ne yapabilir? <\/strong><\/h2>\n<p>Asl\u0131m, sigortas\u0131z \u00e7al\u0131\u015ft\u0131r\u0131lan i\u015f\u00e7ilerin idari ve yarg\u0131 yoluyla haklar\u0131n\u0131 arayabildiklerini anlat\u0131yor. B\u00f6ylesi bir durumda yarg\u0131 yoluna ba\u015fvurulmas\u0131 i\u00e7in di\u011fer idari i\u015flemlerde oldu\u011fu gibi idari yolun t\u00fcketilmesine gerek olmad\u0131\u011f\u0131n\u0131 ifade eden Asl\u0131m, i\u015f\u00e7inin do\u011frudan yarg\u0131 yoluna ba\u015fvurulabildi\u011finin alt\u0131n\u0131 \u00e7iziyor. Asl\u0131m, idari yoldan hak aramada, sigortas\u0131z \u00e7al\u0131\u015ft\u0131r\u0131lan i\u015f\u00e7inin \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u015fyerinin ba\u011fl\u0131 oldu\u011fu Sosyal G\u00fcvenlik Kurumu \u0130l M\u00fcd\u00fcrl\u00fckleri&#8217;ne veya Merkez M\u00fcd\u00fcrl\u00fckleri\u2019ne dilek\u00e7e yazmas\u0131 gerekti\u011fini s\u00f6yl\u00fcyor. S\u00f6zl\u00fc ba\u015fvurular\u0131n dikkate al\u0131nmayaca\u011f\u0131n\u0131 belirten Asl\u0131m, \u015fikayet dilek\u00e7esinin elden verilebilece\u011fi gibi, taahh\u00fctl\u00fc posta ile de g\u00f6nderilebilece\u011fini dile getiriyor. Asl\u0131m, \u201cDilek\u00e7ede i\u015f\u00e7inin \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u015fyerinin ve i\u015fverenin ad\u0131, adresi, biliniyorsa i\u015fyeri sicil numaras\u0131 yaz\u0131lmal\u0131. Bunun d\u0131\u015f\u0131nda i\u015f\u00e7i, o i\u015f yerinde hangi tarihler aras\u0131 \u00e7al\u0131\u015ft\u0131\u011f\u0131n\u0131 a\u00e7\u0131k\u00e7a yazmal\u0131. Dilek\u00e7ede i\u015f\u00e7inin ismi ve imzas\u0131, T. C. kimlik numaras\u0131, a\u00e7\u0131k adresi, telefon numaras\u0131 gibi bilgiler yaz\u0131lmal\u0131. \u015eikayette bulundu\u011fu i\u015fyerindeki \u00e7al\u0131\u015fmalar\u0131na ait belgeler varsa onlar\u0131n fotokopileri de eklenmeli\u201d g\u00f6r\u00fc\u015f\u00fcn\u00fc dile getiriyor. Asl\u0131m, sigortas\u0131z \u00e7al\u0131\u015fan i\u015f\u00e7ilerin Alo 170 Kay\u0131t D\u0131\u015f\u0131 \u0130stihdam Hatt\u0131\u2019na \u015fikayette bulunabildi\u011fini s\u00f6yl\u00fcyor.<\/p>\n<h2><strong>\u0130\u015f\u00e7i \u00e7al\u0131\u015ft\u0131\u011f\u0131 s\u00fcreyi belgelerle kan\u0131tlamal\u0131 <\/strong><\/h2>\n<p>\u0130\u015f\u00e7i i\u015fyerinde \u00e7al\u0131\u015f\u0131yorken \u015fikayette bulunman\u0131n \u00f6nemli oldu\u011funu anlatan Asl\u0131m, SGK kontrol memurunun kendilerine gelen \u015fikayet \u00fczerine i\u015fyerine giderek denetim yapt\u0131\u011f\u0131n\u0131 ve orada \u00e7al\u0131\u015fanlar\u0131 tutana\u011fa ald\u0131\u011f\u0131n\u0131 dile getiriyor. Asl\u0131m, \u201c\u015eikayette bulunan ki\u015fi o an i\u015fyerinde \u00e7al\u0131\u015f\u0131yorsa, \u00e7al\u0131\u015ft\u0131\u011f\u0131 fiilen tespit edilmi\u015f olur. \u0130\u015f\u00e7i, i\u015f yerine tespit yap\u0131lan tarihten \u00f6nce girmi\u015fse ve elinde bunu kan\u0131tlayan belge mevcutsa geriye d\u00f6n\u00fck olarak i\u015f\u00e7iye bir y\u0131la kadar \u00e7al\u0131\u015ft\u0131\u011f\u0131 g\u00fcnlere ait sigortas\u0131\/ hizmeti kazand\u0131r\u0131l\u0131r. Bu haktan sadece \u015fikayette bulunan sigortal\u0131 de\u011fil, i\u015fyerinde yap\u0131lan denetim an\u0131nda sigortas\u0131z olarak \u00e7al\u0131\u015ft\u0131\u011f\u0131\/\u00e7al\u0131\u015ft\u0131r\u0131ld\u0131\u011f\u0131 tespit edilen b\u00fct\u00fcn sigortal\u0131lar yararlan\u0131r\u201d diyor. Asl\u0131m, i\u015f\u00e7inin i\u015fyerinden ayr\u0131ld\u0131ktan veya i\u015ften \u00e7\u0131kar\u0131ld\u0131ktan sonra \u015fikayette bulunmas\u0131 halinde i\u015fyerinde denetim yaparak fiilen tespit etme imkan\u0131n\u0131n ortadan kalkaca\u011f\u0131n\u0131 ifade ediyor.
