Bana sormadan izin plan\u0131 yapmamal\u0131yd\u0131n, Bu i\u015fi iyi beceremiyorsun, o konuyu iyi anlam\u0131yorsun, be\u015f dakika bile ge\u00e7 kalmamal\u0131s\u0131n\u2026\u201d<\/p>\n<p>Bu ve buna benzer k\u00fc\u00e7\u00fck d\u00fc\u015f\u00fcr\u00fcc\u00fc, i\u011fneleyici s\u00f6z ve hakaretler art\u0131k \u00e7al\u0131\u015fan i\u00e7in dava a\u00e7ma sebebi.<\/p>\n<h2><strong>Peki, nedir bu mobbing?<\/strong><\/h2>\n<p>Mobbing kelimesini; mevcut g\u00fcc\u00fcn ya da pozisyonun k\u00f6t\u00fcye kullan\u0131lmas\u0131, sistematik olarak psikolojik \u015fiddet, bask\u0131, ku\u015fatma, taciz, a\u015fa\u011f\u0131lama, tehdit gibi \u015fekillerde tecelli eden duygusal bir sald\u0131r\u0131 olarak tan\u0131mlayabiliriz.<\/p>\n<p><a href=\"http:\/\/www.kariyer.net\/ik-blog\/mobbinge-ugrayan-calisan-ne-yapmali\/\" target=\"_blank\">Mobbing<\/a>, \u00e7al\u0131\u015fan\u0131n sayg\u0131s\u0131z ve zararl\u0131 bir davran\u0131\u015f\u0131n hedefi olmas\u0131yla ba\u015flay\u0131p; i\u015fverenin ima ve alayla kar\u015f\u0131s\u0131ndakinin toplumsal itibar\u0131n\u0131 d\u00fc\u015f\u00fcrmeyi de i\u00e7eren sald\u0131rgan bir ortam yaratarak onu i\u015ften \u00e7\u0131kmaya zorlamas\u0131 olarak ger\u00e7ekle\u015febiliyor. Genellikle ya\u015f, cinsiyet, \u0131rk ayr\u0131m\u0131 olmaks\u0131z\u0131n ki\u015fiyi i\u015f ya\u015fam\u0131ndan d\u0131\u015flamak amac\u0131yla kas\u0131tl\u0131 olarak da yap\u0131labiliyor.<\/p>\n<p>Mobbing uygulayan ki\u015fiye\u00a0<em>\u201cTacizci\u201d<\/em><em>,<\/em>\u00a0mobbing\u2019e maruz kalan ki\u015fiye ise\u00a0<em>\u201c<a href=\"http:\/\/www.kariyer.net\/ik-blog\/is-yerinizde-mobbing-yasiyor-musunuz\/\" target=\"_blank\">ma\u011fdur<\/a><\/em><em>\u201d<\/em>\u00a0deniyor. Psikolojik \u015fiddet, bask\u0131, ku\u015fatma, taciz, rahats\u0131z etme veya s\u0131k\u0131nt\u0131 vermek olan mobbing kavram\u0131n\u0131n kar\u015f\u0131l\u0131\u011f\u0131 olarak T\u00fcrk Dil Kurumu, \u201cBezdiri\u201d kelimesini belirleyerek bezdiriyi \u201c<em>\u0130\u015f yerlerinde, okullarda vb. topluluklar i\u00e7inde belirli bir ki\u015fiyi hedef al\u0131p, \u00e7al\u0131\u015fmalar\u0131n\u0131 sistemli bir bi\u00e7imde engelleyip huzursuz olmas\u0131na yol a\u00e7arak y\u0131ld\u0131rma, d\u0131\u015flama, g\u00f6zden d\u00fc\u015f\u00fcrme<\/em>\u201d olarak tan\u0131mlam\u0131\u015f durumda.<\/p>\n<h2><strong>Psikolojik tacize u\u011frayan \u00e7al\u0131\u015fan ne yapabilir?<\/strong><\/h2>\n<p>Mobbing\u2019e u\u011frayarak i\u015f akdi sonlanan bir ki\u015fi, durumu ispat ederek\u00a0i\u015fe iade davas\u0131 a\u00e7abilir, yasal haklar\u0131n\u0131 talep edebilir ve tazminat davas\u0131 da a\u00e7abilir. Tabii bu geli\u015fmelerin en ba\u015f\u0131nda mobbing\u2019e maruz kalan ki\u015finin bu tezini destekleyecek \u015fahitlerinin ya da elle tutulur belgelerinin olmas\u0131 gerekiyor.<\/p>\n<p>\u015eahitlerden kas\u0131t, ki\u015finin i\u015f arkada\u015f\u0131 ya da ayn\u0131 \u00e7al\u0131\u015fma ortam\u0131nda bulunan ki\u015fi olmak zorunda. Elle tutulur belge ise; mobbing\u2019e u\u011frayan ki\u015finin bu psikolojik taciz s\u00fcrecinin ba\u015flang\u0131c\u0131ndan itibaren kay\u0131t alt\u0131na ald\u0131\u011f\u0131 mesaj, mail veya telefon kayd\u0131 gibi belgelerin olmas\u0131 anlam\u0131na geliyor. \u00dccret kesme cezas\u0131 varsa bordro veya <a href=\"http:\/\/www.kariyer.net\/ik-blog\/ofiste-psikolojimiz-ne-durumda\/\" target=\"_blank\">psikiyatride mobbing<\/a> nedeniyle tedavi g\u00f6rd\u00fc\u011f\u00fcne dair bir raporun sunulmas\u0131 da bu nedenle son derece \u00f6nemli.<\/p>\n<p>\u00c7al\u0131\u015fan, t\u00fcm bu ko\u015fullar\u0131n sa\u011flanmas\u0131 halinde i\u015fe iade davas\u0131 a\u00e7arak kazanabilir, t\u00fcm yasal alacaklar\u0131n\u0131 talep ederek i\u015f akdini yine hakl\u0131 nedenlerle sonland\u0131rabilir ve yine mahkeme karar\u0131na g\u00f6re manevi tazminat talebinde bulunabilir.<\/p>\n<h2><strong>Mobbing&#8217;te ki\u015fisel tazminat davalar\u0131n\u0131n \u00f6n\u00fc a\u00e7\u0131ld\u0131<\/strong><\/h2>\n<p>Bu zamana kadar mobbing uygulayan ki\u015fiye veya y\u00f6neticiye herhangi bir yapt\u0131r\u0131m uygulanm\u0131yor, dava yoluna gidilmesi mahkemece uygun g\u00f6r\u00fclm\u00fcyordu. Ancak Ekim ay\u0131n\u0131n hen\u00fcz ba\u015flar\u0131nda verilen Ankara \u0130stinaf Mahkemesi karar\u0131 emsal te\u015fkil edecek gibi g\u00f6z\u00fck\u00fcyor. Bu \u00f6rnekte; mobbing\u2019e u\u011frayan ki\u015fi direkt olarak y\u00f6neticisine tazminat davas\u0131 a\u00e7\u0131yor ve haliyle Ankara\u2019da bulunan yerel mahkeme bu talebi reddediyor. Bunun \u00fczerine ki\u015fi avukat\u0131 arac\u0131l\u0131\u011f\u0131yla konuyu B\u00f6lge Adliye Mahkemesine ta\u015f\u0131yor. B\u00f6lge Adliye Mahkemesi ise yerel mahkemenin verdi\u011fi karar\u0131 bozarak davac\u0131y\u0131 hakl\u0131 buluyor.<\/p>\n<p>Hen\u00fcz karar a\u015famas\u0131na ge\u00e7ilmemi\u015f olan bu davan\u0131n sonucu b\u00fcy\u00fck ilgi ile takip ediliyor. Ki\u015finin y\u00f6neticisine a\u00e7m\u0131\u015f oldu\u011fu tazminat davas\u0131n\u0131n m\u00fceccel bedeli ise 40 bin lira tutar\u0131nda. \u00d6zellikle kurumsal firmalardaki y\u00f6netim, y\u00f6neticilerinin alt kadrolara uygulad\u0131klar\u0131 bask\u0131y\u0131 g\u00f6rm\u00fcyor veya fark edemiyorlard\u0131, ancak ortaya \u00e7\u0131kan zarar\u0131 \u015firketler \u00f6d\u00fcyordu.
