Mesai saatleri d\u0131\u015f\u0131nda \u00e7al\u0131\u015fmaya devam eden \u00e7al\u0131\u015fanlar, her bir saat i\u00e7in ek \u00fccret al\u0131r. \u00c7al\u0131\u015fanlar\u0131n fazla mesaiye dair haklar\u0131 birtak\u0131m yasal d\u00fczenlemeler ve s\u0131n\u0131rlamalar ile teminat alt\u0131na al\u0131n\u0131r.\u00a0<\/span><\/p>\n<h2><b>Fazla mesaiye dair yasal d\u00fczenleme nas\u0131ld\u0131r?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">T\u00fcrkiye\u2019de \u00e7al\u0131\u015fma hayat\u0131n\u0131 yasal olarak d\u00fczenlemek i\u00e7in 4857 say\u0131l\u0131 \u0130\u015f Kanunu temel al\u0131n\u0131r. \u0130\u015f Kanunu\u2019nun \u201cFazla \u00c7al\u0131\u015fma \u00dccreti\u201d ad\u0131n\u0131 alan 41. maddesi fazla mesaiye dair h\u00fck\u00fcmler, d\u00fczenlemeler ve s\u0131n\u0131rland\u0131rmalar i\u00e7erir. Buna g\u00f6re fazla mesai bir hafta boyunca 45 saatten fazla s\u00fcren \u00e7al\u0131\u015fma zamanlar\u0131na denir. \u0130\u015f Kanunu\u2019nda, fazla \u00e7al\u0131\u015f\u0131lan her bir saat i\u00e7in normal \u00e7al\u0131\u015fma \u00fccretinin %50 oran\u0131nda art\u0131r\u0131lmas\u0131 ile \u00f6deme yap\u0131laca\u011f\u0131na dair bir h\u00fck\u00fcm bulunur.<\/span><\/p>\n<h2><b>En fazla ka\u00e7 saat fazla mesai yap\u0131labilir?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Fazla mesai yasalara g\u00f6re belirli saatlerle s\u0131n\u0131rland\u0131r\u0131l\u0131r. Buna g\u00f6re \u0130\u015f Kanunu\u2019nun 41. maddesi uyar\u0131nca \u00e7al\u0131\u015fanlar\u0131n bir senede en fazla 270 saat fazla mesai yapabilecekleri y\u00f6n\u00fcnde bir h\u00fck\u00fcm bulunur. Bu s\u0131n\u0131r ayl\u0131k olarak 22.5 saate kar\u015f\u0131l\u0131k gelir. Bu yasal s\u0131n\u0131rland\u0131rman\u0131n i\u015f\u00e7i ve i\u015fveren aras\u0131nda yap\u0131lacak bir i\u015f s\u00f6zle\u015fmesi ile art\u0131r\u0131lmas\u0131 m\u00fcmk\u00fcn de\u011fildir. \u0130\u015fveren taraf\u0131ndan y\u0131lda 270 saatten fazla ek \u00e7al\u0131\u015fma talep edilirse, \u00e7al\u0131\u015fanlar hakl\u0131 fesih ile i\u015f akdini sonland\u0131rma hakk\u0131na sahip olur. \u0130laveten hak ihlali nedeniyle i\u015f yerine dava da a\u00e7abilir.<\/span><\/p>\n<h2><b>Kanunen kimler fazla mesai yapamaz?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Fazla mesai \u00fccreti ve s\u00fcresi baz\u0131 mesleklere ve \u00e7al\u0131\u015fan gruplar\u0131na uygulanmaz. Buna g\u00f6re fazla \u00e7al\u0131\u015fmadan do\u011fan \u00fccretin \u00f6denmesi i\u00e7in belirlenen zaman a\u015f\u0131m\u0131 s\u00fcresi 5 y\u0131ld\u0131r. 5 sene i\u00e7erisinde \u00f6demesi yap\u0131lmayan i\u015f\u00e7iler, yasal yollarla haklar\u0131n\u0131 arayabilirler.\u00a0<\/span><\/p>\n<h2><b>Fazla mesai \u00fccreti nas\u0131l \u00f6denir?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Fazla \u00e7al\u0131\u015fma \u00fccreti, <strong><a href=\"https:\/\/www.kariyer.net\/maas-hesaplama\" target=\"_blank\" rel=\"noopener\">br\u00fct maa\u015f<\/a><\/strong> \u00fczerinden hesaplan\u0131r. Burada \u00e7al\u0131\u015fanlar\u0131n fazla mesaiden do\u011fan haklar\u0131n\u0131n \u00f6denmedi\u011fi durumlara ili\u015fkin h\u00fck\u00fcmler yer al\u0131r. 34. maddede \u201c\u00dccreti \u00f6deme g\u00fcn\u00fcnden itibaren yirmi g\u00fcn i\u00e7inde m\u00fccbir bir neden d\u0131\u015f\u0131nda \u00f6denmeyen i\u015f\u00e7i, i\u015f g\u00f6rme borcunu yerine getirmekten ka\u00e7\u0131nabilir.\u201d \u015feklinde bir h\u00fck\u00fcm bulunur. Bununla birlikte i\u015fverene fazla \u00e7al\u0131\u015fma bedelini \u00f6demedi\u011fi i\u00e7in i\u015fe devam etmeyen \u00e7al\u0131\u015fan\u0131n\u0131n i\u015f akdini tek tarafl\u0131 sonland\u0131rma hakk\u0131n\u0131 tan\u0131maz.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00d6te yandan i\u015fveren, fazla \u00e7al\u0131\u015fma \u00fccreti \u00f6denmedi\u011fi i\u00e7in i\u015fe gelmeyen \u00e7al\u0131\u015fan\u0131n i\u015f akdini tek tarafl\u0131 sonland\u0131ramaz ve yerine ba\u015fka birini istihdam edemez. Ancak \u00e7al\u0131\u015fan ki\u015finin ilgili kanunun 24. maddesine g\u00f6re i\u015fveren taraf\u0131ndan \u00f6denmeyen ek \u00e7al\u0131\u015fma \u00fccretleri sebebiyle i\u015f s\u00f6zle\u015fmesini feshetme hakk\u0131 bulunur. Yasal yollara ba\u015fvurarak hakk\u0131n\u0131 arayabilir. \u00c7al\u0131\u015fanlar\u0131n hukuki haklar\u0131n\u0131 aramas\u0131 i\u00e7in fazla mesai \u00fccretinin tamam\u0131n\u0131n ya da bir b\u00f6l\u00fcm\u00fcn\u00fcn \u00f6denmemi\u015f olmas\u0131 gibi ko\u015fullar ileri s\u00fcr\u00fclemez.<\/span><\/p>\n<h2><b>Fazla mesai saati hesaplamas\u0131 nas\u0131l yap\u0131l\u0131r?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Fazla mesai hesaplamas\u0131 yap\u0131l\u0131rken baz\u0131 metotlardan yararlan\u0131l\u0131r. Resmi tatillerde oldu\u011fu gibi pazar g\u00fcn\u00fc de ek \u00f6deme alabilirler. \u0130\u015fverenlerin hafta sonu \u00e7al\u0131\u015fan i\u015f\u00e7ilere g\u00fcnl\u00fck br\u00fct \u00fccretin 2.5 kat\u0131 oran\u0131nda \u00f6deme yapmas\u0131 gerekir. S\u00f6zle\u015fmesinin devam etmesi belirlenen s\u00fcrenin ba\u015flamas\u0131na engel olmaz.<\/span><\/p>\n<h2><b>Fazla mesai davas\u0131\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Fazla \u00e7al\u0131\u015fma \u00fccreti ile ilgili ya\u015fanan anla\u015fmazl\u0131klar konusunda \u0130\u015f Mahkemeleri g\u00f6revlidir. \u0130\u015f\u00e7inin fazla \u00e7al\u0131\u015fma \u00fccretinin i\u015fveren taraf\u0131ndan \u00f6denmemesi ya da k\u0131smi olarak \u00f6denmesi durumunda \u00f6ncelikle arabuluculuk faaliyetinin ger\u00e7ekle\u015ftirilmesi mahkeme \u015fart\u0131 olarak \u00f6ne s\u00fcr\u00fcl\u00fcr. Bunun sonucunda uzla\u015fmaya var\u0131lamazsa, i\u015f mahkemelerine dava a\u00e7\u0131lmas\u0131 gerekir. Davac\u0131, arabuluculuk ile anla\u015fmaya var\u0131lamad\u0131\u011f\u0131na ait son tutana\u011f\u0131n asl\u0131n\u0131 ya da arabulucu taraf\u0131ndan onaylanan \u00f6rne\u011fini dava dilek\u00e7esine eklemekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Fazla mesai davalar\u0131nda \u00e7al\u0131\u015fan fazla mesai yapt\u0131\u011f\u0131n\u0131 kan\u0131tlamakla y\u00fck\u00fcml\u00fcd\u00fcr. \u0130\u015fveren ise fazla mesai \u00fccretini \u00f6dedi\u011fine dair kan\u0131t sunmak zorundad\u0131r. Fazla mesai davalar\u0131nda zaman a\u015f\u0131m\u0131 s\u00fcresi 5 senedir. Fazla mesaisi \u00f6denmeyen \u00e7al\u0131\u015fan, hakl\u0131 fesih hakk\u0131n\u0131 \u00f6ne s\u00fcrebilir. Bu durumda i\u015f\u00e7i hakl\u0131 gerek\u00e7e g\u00f6stermek suretiyle i\u015f akdini sonland\u0131rabilir. \u00c7al\u0131\u015fan i\u015f akdini sona erdirdikten sonra dava a\u00e7ma hakk\u0131n\u0131 kullanabilir. \u0130\u015f\u00e7inin talebini kan\u0131tlamas\u0131 halinde fazla mesai alaca\u011f\u0131 kendisine faiziyle birlikte \u00f6denir.<\/span><\/p>\n<h2><b>Fazla mesaiye dair bilinmesi gerekenler<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Ek \u00e7al\u0131\u015fma s\u00fcreleriyle ilgili hala cevaplayamad\u0131\u011f\u0131n sorular varsa a\u015fa\u011f\u0131daki noktalara dikkat ederek soru i\u015faretlerini giderebilirsin:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Fazla mesai mecburi de\u011fildir.
