Ge\u00e7ici i\u015f g\u00f6remezlik nedir, rapor nas\u0131l al\u0131n\u0131r, \u00f6demeler ne zaman yap\u0131l\u0131r sorular\u0131n\u0131n cevab\u0131 bu yaz\u0131m\u0131zda!<\/strong><\/p>\n<h2><strong>\u0130\u015f g\u00f6remezlik raporu ne demektir?<\/strong><\/h2>\n<p>\u0130\u015f g\u00f6remezlik; sigortal\u0131 \u00e7al\u0131\u015fan\u0131n meslek hastal\u0131\u011f\u0131, anal\u0131k, hastal\u0131k, kaza gibi \u00e7e\u015fitli sebeplerle sa\u011fl\u0131k raporlar\u0131nda belirtilen s\u00fcre boyunca ge\u00e7ici olarak \u00e7al\u0131\u015famama durumudur. Ge\u00e7ici i\u015f g\u00f6remezlik raporu say\u0131lan gerek\u00e7elerle yetkili bir sa\u011fl\u0131k kurulu ya da hekimler taraf\u0131ndan haz\u0131rlanarak sigorta kurumuna ve i\u015f yerine sunulan belgedir. \u0130\u015f g\u00f6rememe durumunda \u00e7al\u0131\u015fanlara bir \u00f6deme yap\u0131l\u0131r. \u0130stirahat halinde bulunan sigortal\u0131 i\u015f\u00e7iye i\u015ften uzak kald\u0131\u011f\u0131 g\u00fcn say\u0131s\u0131na g\u00f6re sigorta kurumu taraf\u0131ndan yap\u0131lan maddi yard\u0131ma ise <strong>ge\u00e7ici i\u015f g\u00f6remezlik \u00f6dene\u011fi<\/strong> ad\u0131 verilir.<\/p>\n<h2><strong>\u0130\u015f g\u00f6remezlik raporu nas\u0131l al\u0131n\u0131r?<\/strong><\/h2>\n<p>Sa\u011fl\u0131k ve gebelik gibi sebeplerle sigortal\u0131 \u00e7al\u0131\u015fanlar\u0131n i\u015fe gidemedikleri s\u00fcre boyunca meydana gelen maddi kayb\u0131 kar\u015f\u0131lamak i\u00e7in i\u015f g\u00f6remezlik raporu al\u0131n\u0131r. Bu raporun al\u0131nabilmesi i\u00e7in \u00e7al\u0131\u015fanlar\u0131n en az 3 g\u00fcn boyunca i\u015ften uzak kalmas\u0131 gerekir. 2 g\u00fcnl\u00fck sa\u011fl\u0131k raporu al\u0131nmas\u0131 durumunda i\u015fverenler, \u00e7al\u0131\u015fanlar\u0131n\u0131n maa\u015f\u0131ndan kesinti yapmaz. 2 g\u00fcnl\u00fck raporlar i\u00e7in SGK taraf\u0131ndan herhangi bir \u00f6denek al\u0131namaz. \u0130\u015f g\u00f6remezlik \u00f6dene\u011finin al\u0131nabilmesi i\u00e7in raporun minimum 3 g\u00fcn ya da daha fazla g\u00fcnl\u00fck istirahat i\u00e7in d\u00fczenlenmi\u015f olmas\u0131 gerekir. Bununla birlikte raporun SGK taraf\u0131ndan yetki verilmi\u015f hastanelerden ve uzman doktorlardan al\u0131nm\u0131\u015f olmas\u0131 zorunludur. Sigortal\u0131 ki\u015filerin bu \u00f6denekten yararlanabilmesi i\u00e7in bir di\u011fer \u00f6nemli nokta ise son bir sene i\u00e7erisinde \u00e7al\u0131\u015fan\u0131n 90 g\u00fcnl\u00fck sigorta priminin yat\u0131r\u0131lm\u0131\u015f olmas\u0131d\u0131r.<\/p>\n<h2><strong>\u0130\u015f g\u00f6remezlik raporu hangi durumlarda al\u0131n\u0131r?<\/strong><\/h2>\n<p>\u0130\u015f g\u00f6remezlik \u00f6demesi; \u00e7al\u0131\u015fanlar\u0131n i\u015f kazas\u0131, hastal\u0131k, meslek hastal\u0131\u011f\u0131 veya anal\u0131k gibi ge\u00e7ici olarak i\u015f yapamaz duruma gelmeleri durumunda ya\u015fayacaklar\u0131 gelir kayb\u0131n\u0131n \u00f6n\u00fcne ge\u00e7mek i\u00e7in SGK taraf\u0131ndan yap\u0131lan sigorta \u00f6demesidir. \u00c7al\u0131\u015fanlar\u0131n ge\u00e7ici olarak \u00e7al\u0131\u015fmaya devam edemeyece\u011fi bu durumlarda maa\u015f \u00f6demelerini i\u015fveren de\u011fil SGK yapar. Bu \u00f6demeler kimi zaman mahsupla\u015fma yoluyla da uygulanabilir. \u0130\u015fletme ve SGK aras\u0131nda imzalanan bir mahsupla\u015fma protokol\u00fc varsa maa\u015f \u00f6demesi raporlu olunan s\u00fcre boyunca i\u015fletme taraf\u0131ndan yap\u0131l\u0131r. Daha sonra SGK taraf\u0131ndan i\u015fletmenin prim bor\u00e7lar\u0131ndan mahsup edilir.<\/p>\n<p>\u0130\u015f g\u00f6remezlik raporu yaln\u0131zca belirli durum ve \u015fartlara ba\u011fl\u0131 olarak al\u0131nabilir. Sa\u011fl\u0131kla ili\u015fkilendirilebilecek gerek\u00e7eler \u015f\u00f6yle s\u0131ralan\u0131r:<\/p>\n<h3><strong>Meslek hastal\u0131\u011f\u0131<\/strong><\/h3>\n<p>Meslek hastal\u0131\u011f\u0131, sigortal\u0131 ki\u015finin \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u00e7in niteli\u011finden ve \u015fartlar\u0131ndan dolay\u0131 tekrar eden bir nedenle maruz kald\u0131\u011f\u0131 ge\u00e7ici ya da s\u00fcrekli hastal\u0131k, bedensel veya ruhsal olarak olu\u015fan engellilik durumu olarak tan\u0131mlan\u0131r. Bu durumun kabul\u00fc i\u00e7in yetkili bir sa\u011fl\u0131k kurulundan heyet raporu al\u0131nmas\u0131, t\u0131bbi evraklar\u0131n ve raporun kurum taraf\u0131ndan incelenerek belirlenmesi gerekir. Meslek hastal\u0131klar\u0131 olduk\u00e7a uzun bir s\u00fcre sonra da ortaya \u00e7\u0131kabilir. Bu nedenle \u00e7al\u0131\u015f\u0131lan d\u00f6nemde i\u015f yerindeki kay\u0131tlar\u0131n d\u00fczenli olarak tutulmas\u0131 son derece \u00f6nemlidir. Aksi halde uzun y\u0131llar sonra ortaya \u00e7\u0131kan bir meslek hastal\u0131\u011f\u0131 sebebiyle ge\u00e7ici i\u015f g\u00f6remezlik \u00f6demesi ba\u015fvurusu yap\u0131ld\u0131\u011f\u0131 zaman mevcut rahats\u0131zl\u0131\u011f\u0131n bir meslek hastal\u0131\u011f\u0131 oldu\u011funu ispat etmek g\u00fc\u00e7 bir hal alabilir.<\/p>\n<h3><strong>Anal\u0131k hali<\/strong><\/h3>\n<p>Do\u011fumdan sonraki ilk sekiz haftal\u0131k s\u00fcreci kapsayan gebelik ve anal\u0131k durumuyla ilgili hastal\u0131k ve engel, anal\u0131k hali olarak kabul edilir. Bu s\u00fcre \u00e7o\u011ful gebeliklerde onuncu haftaya kadar uzat\u0131l\u0131r. Anal\u0131k hali i\u00e7in kad\u0131n\u0131n sigortal\u0131 olarak \u00e7al\u0131\u015fmas\u0131 ya da sigortas\u0131zsa e\u015finin sigortal\u0131 olmas\u0131 gerekir.<\/p>\n<h3><strong>\u0130\u015f kazas\u0131<\/strong><\/h3>\n<p>\u0130\u015f kazas\u0131, 5510 say\u0131l\u0131 Kanunda beyan edilen hallerden biriyle ilgili meydana gelen ve sigortal\u0131 \u00e7al\u0131\u015fan\u0131 bedenen ya da ruhen engelli hale getiren durumlara denir. 5510 say\u0131l\u0131 Kanunda belirtilen i\u015f kazas\u0131 halleri \u015f\u00f6yle s\u0131ralan\u0131r:<\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li>Sigortal\u0131n\u0131n i\u015f yerinde bulundu\u011fu s\u0131rada i\u015fveren taraf\u0131ndan i\u015f yeri d\u0131\u015f\u0131nda ba\u015fka bir yere g\u00f6nderilmesi nedeniyle as\u0131l i\u015fini yapmadan ge\u00e7en zamanlarda,<\/li>\n<li>\u0130\u015f akdiyle \u00e7al\u0131\u015fan sigortal\u0131n\u0131n, \u00e7ocu\u011funu emzirmesi i\u00e7in ayr\u0131lan zamanlarda,<\/li>\n<li>Sigortal\u0131lar\u0131n, i\u015fveren taraf\u0131ndan temin edilen bir ara\u00e7la \u00e7al\u0131\u015fman\u0131n yap\u0131ld\u0131\u011f\u0131 yere gidi\u015f ve geli\u015fi esnas\u0131nda,<\/li>\n<li>Kendi ad\u0131na ba\u011f\u0131ms\u0131z \u00e7al\u0131\u015f\u0131yorsa y\u00fcr\u00fctmekte oldu\u011fu i\u015f sebebiyle meydana gelen olaylar.<\/li>\n<\/ul>\n<h3><strong>Hastal\u0131k hali<\/strong><\/h3>\n<p>Sigortal\u0131 \u00e7al\u0131\u015fanlar\u0131n meslek hastal\u0131\u011f\u0131 ve i\u015f kazas\u0131 d\u0131\u015f\u0131nda bulunan ve i\u015f g\u00f6rememe durumuna yol a\u00e7an hastal\u0131k ve rahats\u0131zl\u0131klar\u0131n t\u00fcm\u00fc &#8220;hastal\u0131k hali&#8221; olarak adland\u0131r\u0131l\u0131r.<\/p>\n<p>\u00c7al\u0131\u015fanlar\u0131n ge\u00e7ici i\u015f g\u00f6remezlik \u00f6dene\u011fi alabilmesi i\u00e7in;<\/p>\n<ul>\n<li>\u0130\u015f g\u00f6remezlik durumunun ba\u015flad\u0131\u011f\u0131 tarihten itibaren geriye d\u00f6n\u00fck olarak son bir y\u0131l i\u00e7erisinde 90 g\u00fcn k\u0131sa vadeli sigorta primini beyan edilmi\u015f olmas\u0131,<\/li>\n<li>Sigorta kurumu taraf\u0131ndan yetki verilmi\u015f sa\u011fl\u0131k kurulu ve hekimlerce raporun haz\u0131rlanm\u0131\u015f olmas\u0131,<\/li>\n<li>\u0130stirahat halinin ba\u015flad\u0131\u011f\u0131 tarihte \u00e7al\u0131\u015fan\u0131n sigortal\u0131l\u0131k durumunun devam ediyor olmas\u0131 gerekir.<\/li>\n<\/ul>\n<h2><strong>Ge\u00e7ici i\u015f g\u00f6remezlik \u00f6demesi nas\u0131l al\u0131n\u0131r?<\/strong><\/h2>\n<p>\u0130\u015f g\u00f6remezlik \u00f6demesi i\u00e7in a\u015fa\u011f\u0131daki \u015fartlar\u0131n kar\u015f\u0131lanmas\u0131 gerekir:<\/p>\n<ul>\n<li>Sigortal\u0131 \u00e7al\u0131\u015fan; hastal\u0131k, meslek hastal\u0131\u011f\u0131, anal\u0131k, i\u015f kazas\u0131 nedeniyle i\u015f g\u00f6remez durumda oldu\u011funu Sosyal G\u00fcvenlik Kurumu\u2019nca yetki verilmi\u015f olan doktorlardan veya sa\u011fl\u0131k kurullar\u0131nca verilen sa\u011fl\u0131k raporu ile bildirmelidir.<\/li>\n<li>Sigortal\u0131 ad\u0131na rapor tarihinden \u00f6nceki 90 g\u00fcn SSK priminin \u00f6denmi\u015f olmas\u0131 \u015fartt\u0131r. \u0130\u015f kazas\u0131 ba\u015fvurular\u0131nda bu ko\u015ful s\u00f6z konusu de\u011fildir.<\/li>\n<\/ul>\n<p>Ge\u00e7ici i\u015f g\u00f6remezlik \u00f6demesini almak i\u00e7in sigortal\u0131 \u00e7al\u0131\u015fan, durumunu beyan eden hekim raporu ile beraber SGK\u2019ya ba\u015fvurmal\u0131d\u0131r. Ba\u015fvuru sonras\u0131 sonu\u00e7 E-devlet\u2019ten takip edilebilir. Gereken ko\u015fullar sa\u011flanm\u0131\u015fsa ba\u015fvuru tarihinden ba\u015flanarak en ge\u00e7 15 g\u00fcn i\u00e7inde \u00f6deme yap\u0131l\u0131r. \u00d6deme PTT \u00fczerinden ger\u00e7ekle\u015ftirilir.<strong>\u00a0<\/strong><\/p>\n<h2><strong>\u0130\u015f g\u00f6remezlik \u00f6demesi ne zaman yatar?<\/strong><\/h2>\n<p>Ge\u00e7ici i\u015f g\u00f6remezlik \u00f6demesi, raporun 3. g\u00fcn\u00fcnden itibaren yap\u0131lmaya ba\u015flan\u0131r. Bununla birlikte ilk iki g\u00fcnl\u00fck rapor \u00fccretinin i\u015fveren taraf\u0131ndan \u00f6denece\u011fi ile ilgili yasal bir d\u00fczenleme yoktur. 1 ya da 2 g\u00fcnl\u00fck raporu bulunan sigortal\u0131 \u00e7al\u0131\u015fanlara SGK taraf\u0131ndan herhangi bir \u00f6deme yap\u0131lmas\u0131 s\u00f6z konusu de\u011fildir. Bununla birlikte ge\u00e7ici i\u015f g\u00f6remezlik \u00f6dene\u011fi kapsam\u0131nda i\u015f kazas\u0131 ya\u015fayanlarla ilgili olarak istisnai bir durum vard\u0131r. \u0130\u015f kazas\u0131 gerek\u00e7esiyle rapor alan sigortal\u0131 \u00e7al\u0131\u015fanlara SGK taraf\u0131ndan her g\u00fcn \u00f6deme yap\u0131l\u0131r. Sa\u011fl\u0131k aktivasyonu i\u00e7in 30 g\u00fcnl\u00fck prim ko\u015fulu ve geriye d\u00f6n\u00fck 90 g\u00fcn \u00e7al\u0131\u015fma mecburiyeti de aranmaz. Rapor \u00f6demeleri raporun SGK\u2019ya iletilmesinden sonra en fazla 15 g\u00fcnde PTT \u00fczerinden \u00e7al\u0131\u015fan\u0131n hesab\u0131na yat\u0131r\u0131l\u0131r. Ancak \u00f6demenin hesaba aktar\u0131lmas\u0131ndan sonra belirli bir zaman i\u00e7erisinde teslim al\u0131nmas\u0131 gerekir. Aksi halde al\u0131nmayan \u00f6denekler SGK\u2019ya geri g\u00f6nderilir.<\/p>\n<h2><strong>\u0130\u015f g\u00f6remezlik \u00fccreti ne kadard\u0131r?<\/strong><\/h2>\n<p>Ge\u00e7ici i\u015f g\u00f6remezlik \u00f6dene\u011fi hastal\u0131k durumunda kurum taraf\u0131ndan yetkilendirilen doktor ya da sa\u011fl\u0131k kurullar\u0131ndan rapor al\u0131nm\u0131\u015f olmas\u0131 ko\u015fuluyla sigortal\u0131ya i\u015f g\u00f6remezli\u011fin \u00fc\u00e7\u00fcnc\u00fc g\u00fcn\u00fcnden ba\u015flayarak her g\u00fcn i\u00e7in verilir. Hastal\u0131k halinde verilen ge\u00e7ici \u00f6denek, ayaktan tedavilerde g\u00fcnl\u00fck kazanc\u0131n \u00fc\u00e7te ikisi, yatarak tedavilerde ise g\u00fcnl\u00fck kazanc\u0131n\u0131n yar\u0131s\u0131n\u0131 olu\u015fturur.<\/p>\n<h2><strong>\u0130\u015f g\u00f6remezlik \u00f6demesi nas\u0131l hesaplan\u0131r?<\/strong><\/h2>\n<p>Ge\u00e7ici i\u015f g\u00f6remezlik \u00f6demesi hesaplan\u0131rken rapordan \u00f6nceki son 3 ayda yap\u0131lan \u00f6demeler temel al\u0131n\u0131r. Son 3 ayda \u00e7al\u0131\u015f\u0131lmad\u0131ysa daha geriye gidilir. Varsa ikramiye ve prim gibi \u00f6demeler de hesaplamada g\u00f6z \u00f6n\u00fcnde bulundurulur. Total \u00f6deme toplam g\u00fcn say\u0131s\u0131na b\u00f6l\u00fcnerek elde edilen say\u0131, -raporun ilk 2 g\u00fcn\u00fc \u00f6deme olmayaca\u011f\u0131 i\u00e7in- raporlu olunan g\u00fcn\u00fcn 2 eksi\u011fiyle \u00e7arp\u0131l\u0131r. Tedavi bi\u00e7iminin yatarak ya da ayakta olmas\u0131na g\u00f6re hesap tamamlan\u0131r. Ayakta tedavilerde \u2154, yatarak tedavilerde \u00bd oran\u0131nda \u00f6deme al\u0131n\u0131r.<\/p>\n<p>Bir \u00f6rnekle a\u00e7\u0131klamak gerekirse;<\/p>\n<p>Sigortal\u0131 bir \u00e7al\u0131\u015fan\u0131n ayl\u0131k br\u00fct maa\u015f\u0131n\u0131n 10.000.000 TL, prim say\u0131s\u0131n\u0131n da 90 g\u00fcn oldu\u011funu d\u00fc\u015f\u00fcnelim. Bu durumda;<\/p>\n<p>10.000.000 \u00d7 3 = 30.000.000 TL<\/p>\n<p>30.000.000 \/ 90 = 333 TL<\/p>\n<p>Bu durumda sigortal\u0131n\u0131n i\u015f g\u00f6remezlik \u00f6dene\u011fi \u015f\u00f6yle hesaplan\u0131r:<\/p>\n<p>Yatarak tedavi i\u00e7in: 333 \/ 2 = 166,50 TL<\/p>\n<p>Ayakta tedavi i\u00e7in: 333 \/ 3 = 111,00 TL<\/p>\n<p>Peki, ilk i\u015f g\u00fcn\u00fc kaza meydana gelirse hesaplama nas\u0131l yap\u0131l\u0131r? Sigortal\u0131 \u00e7al\u0131\u015fan i\u015fe ba\u015flad\u0131\u011f\u0131 g\u00fcn kaza ge\u00e7irirse, ayn\u0131 i\u015fte \u00e7al\u0131\u015fan ba\u015fka bir sigortal\u0131n\u0131n kazanc\u0131 temel al\u0131narak \u00f6deme miktar\u0131 hesaplan\u0131r.<\/p>\n<h2><strong>Sigortal\u0131l\u0131k hali ne zaman sona erer?<\/strong><\/h2>\n<p>Hastal\u0131k durumunda sigortal\u0131l\u0131k hali; sigortal\u0131 \u00e7al\u0131\u015fan\u0131n yasal olarak \u00fccretsiz izinli olmas\u0131, grevde bulunmas\u0131 ya da i\u015fverenin lokavt yapmas\u0131 halinde bu hallerin sona ermesini, di\u011fer durumlarda ise hizmet akdinin sona erdi\u011fi tarihi ya da terk tarihini izleyen 10. g\u00fcnden ba\u015flanarak kaybetmi\u015f say\u0131l\u0131r.
