Bu hak Anayasa kapsam\u0131nda da g\u00fcvence alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Anayasan\u0131n 50. Maddesinde \u201cdinlenmek \u00e7al\u0131\u015fan\u0131n hakk\u0131d\u0131r\u201d ifadesi senelik izni kapsad\u0131\u011f\u0131 gibi bayram tatilleri ve hafta sonu dinlenme tatillerini de vurgular.<\/span><\/p>\n<p><b>\u0130\u015f kanunu y\u0131ll\u0131k izin s\u00fcreleri <\/b><span style=\"font-weight: 400;\">hakk\u0131nda detaylar\u0131 en net \u015fekilde aktar\u0131r. Kanun \u00e7er\u00e7evesinde hem \u00e7al\u0131\u015fan\u0131 hem de i\u015fvereni kapsayan bu konunun sorunsuz \u015fekilde yerine getirilmesi i\u015f\u00e7inin hakk\u0131d\u0131r. Bu y\u00fck\u00fcml\u00fcl\u00fck i\u015fverene ait olup kanun kapsam\u0131nda sunulan g\u00fcn say\u0131s\u0131 kadar \u00e7al\u0131\u015fana tatil hakk\u0131 tan\u0131nmal\u0131d\u0131r. \u00d6zel sekt\u00f6r ya da kamuda \u00e7al\u0131\u015fan biri olarak hak edi\u015finin ne kadar oldu\u011funu merak edebilirsin. Kanunlar kapsam\u0131nda senelik tatil hak edi\u015fleri \u00e7al\u0131\u015f\u0131lan zamana ve k\u0131deme g\u00f6re de\u011fi\u015fir. Bu ba\u011flamda kanuni olarak <\/span><b>i\u015f\u00e7i y\u0131ll\u0131k izin s\u00fcreleri<\/b><span style=\"font-weight: 400;\"> \u015fu \u015fekildedir;<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">1 sene ile 5 sene aras\u0131nda hizmet verenlere 14 g\u00fcn,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">5 sene ve 15 sene aras\u0131 hizmet verenlere 20 g\u00fcn,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">15 sene ve daha fazla hizmet verenlere 26 g\u00fcn,<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Belirtilen g\u00fcn say\u0131lardan daha az\u0131n\u0131n kulland\u0131r\u0131lmas\u0131 yasal olarak uygun de\u011fildir. Hak edilen s\u00fcre ne kadar fazla ise i\u015f\u00e7inin k\u0131dem seviyesi de ayn\u0131 oranda fazlad\u0131r. \u0130\u015f\u00e7i ve \u00e7al\u0131\u015fanlar \u00e7al\u0131\u015ft\u0131klar\u0131 sene hesaplamas\u0131n\u0131 yaparak yasal mevzuata g\u00f6re ka\u00e7 g\u00fcn hak edi\u015fleri oldu\u011fu konusunda fikir sahibi olabilir. Sen de \u00f6zel sekt\u00f6rde hizmet veriyorsan, yukar\u0131da yer alan detaylar\u0131 baz alarak ne kadar hak edi\u015fin oldu\u011funa dair bilgi sahibi olabilirsin.<\/span><\/p>\n<h2><b>Y\u0131ll\u0131k izinde ya\u015f i\u00e7in \u00f6zel d\u00fczenleme var m\u0131?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Bu konuda ya\u015f fakt\u00f6r\u00fc de kanuni olarak nettir. Kanunlar kapsam\u0131nda belirtilen detaya g\u00f6re 18 ya\u015f\u0131ndan daha k\u00fc\u00e7\u00fck olanlar ve 50 ya\u015f\u0131ndan daha b\u00fcy\u00fck olanlar i\u00e7in verilmesi gereken <\/span><b>kanuni y\u0131ll\u0131k izin s\u00fcreleri <\/b><span style=\"font-weight: 400;\">en az 20 g\u00fcn olmak zorundad\u0131r. Bu zamandan daha az\u0131n\u0131n verilmesi kanuni olarak yasakt\u0131r. Kanunla\u015ft\u0131r\u0131lm\u0131\u015f bu detaya g\u00f6re \u00f6rnek vermek gerekirse 16 ya\u015f\u0131ndan daha k\u00fc\u00e7\u00fck olan bir i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131\u011f\u0131 zaman 5 y\u0131ldan daha az olsa bile 19 ya\u015f\u0131na girinceye kadar bu s\u00fcre her sene 14 yerine 20 g\u00fcn olmal\u0131d\u0131r. Stajyer olarak ya da farkl\u0131 bir pozisyonda \u00e7al\u0131\u015fan 16 ya\u015f\u0131ndan b\u00fcy\u00fck biriysen sen de bu bilgi dahilinde <\/span><b>y\u0131ll\u0131k izin s\u00fcreleri<\/b><span style=\"font-weight: 400;\"> kapsam\u0131nda talepte bulunabilirsin.<\/span><\/p>\n<h2><b>Y\u0131ll\u0131k izin neye g\u00f6re belirlenir?<\/b><\/h2>\n<p><b>Y\u0131llara g\u00f6re y\u0131ll\u0131k izin s\u00fcreleri<\/b><span style=\"font-weight: 400;\"> kanun dahilinde net olarak sunulur. \u00c7al\u0131\u015fanlar\u0131n dinlenmesini esas alan hakta k\u0131demin \u00f6nemi \u00f6n plana \u00e7\u0131kar. \u00c7al\u0131\u015f\u0131lan sene, ya\u015f fakt\u00f6r\u00fc gibi birden fazla de\u011fi\u015fkene g\u00f6re yasal kapsamda sunulan hak de\u011fi\u015fkenlik g\u00f6sterir. \u00c7al\u0131\u015fan bir i\u015f yerinde 1 ile 5 sene aras\u0131nda \u00e7al\u0131\u015fm\u0131\u015fsa bu s\u00fcre 14 g\u00fcnden az olamaz. Yine ayn\u0131 \u00e7al\u0131\u015fan i\u015f yerinde 5-15 sene aras\u0131nda hizmet vermeye devam etmi\u015fse rakam 20 g\u00fcne \u00e7\u0131kar. 15 sene ve \u00fczeri kesintisiz \u00e7al\u0131\u015fmaya devam eden bir \u00e7al\u0131\u015fan i\u00e7in yasal s\u00fcre de 26 g\u00fcnden daha az olmayacak \u015fekilde d\u00fczenlenmi\u015ftir. Kamu \u00e7al\u0131\u015fanlar\u0131 i\u00e7in yasal kapsamda olan bu s\u00fcreler \u00f6zel sekt\u00f6re g\u00f6re daha farkl\u0131d\u0131r. Belirlenen yasal d\u00fczenleme dahilinde <\/span><b>memur y\u0131ll\u0131k izin s\u00fcreleri<\/b><span style=\"font-weight: 400;\"> \u015f\u00f6yle d\u00fczenlenir:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">1-10 sene aras\u0131 hizmet veren devlet memurlar\u0131 20 g\u00fcn<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">10 sene ve \u00fczeri hizmet devam eden devlet memurlar\u0131 30 g\u00fcn<\/span><\/li>\n<\/ul>\n<h2><b>Y\u0131ll\u0131k izin nas\u0131l hesaplan\u0131r?<\/b><\/h2>\n<p><b>Y\u0131ll\u0131k izin s\u00fcreleri hesaplama<\/b><span style=\"font-weight: 400;\"> detaylar\u0131 \u00fccret almak i\u00e7in de talep edilir. Senelik hesaplamada\u00a0 g\u00fcn say\u0131s\u0131 kanun kapsam\u0131nda nettir. Baz\u0131 \u00e7al\u0131\u015fanlar bu haklar\u0131n\u0131 kullanmak yerine \u00fccretini alma hakk\u0131n\u0131 kullanmak da isteyebilir. E\u011fer sen de hak etti\u011fin s\u00fcreni nakit olarak almay\u0131 talep ediyorsan hesaplama detaylar\u0131n\u0131 bilmen gerekir. \u0130\u015f kanunu bu konuda da detayl\u0131 bilgilere yer vermi\u015ftir. \u0130\u015f kanununa g\u00f6re herhangi bir i\u015f yerinde 18 ay boyunca aktif \u00e7al\u0131\u015fan bir \u00e7al\u0131\u015fan hen\u00fcz 2 senesini doldurmad\u0131\u011f\u0131 i\u00e7in k\u0131demi 1 sene olarak kabul edilir. Bu gibi durumlarda \u00e7al\u0131\u015fan\u0131n hakk\u0131 14 g\u00fcnd\u00fcr. \u00d6rneklemek gerekirse g\u00fcnl\u00fck kazanc\u0131 10 TL olan bir \u00e7al\u0131\u015fan paras\u0131n\u0131 almak i\u00e7in g\u00fcn say\u0131s\u0131 ve ald\u0131\u011f\u0131 \u00fccreti \u00e7arpmal\u0131d\u0131r. <\/span><b>Emekli y\u0131ll\u0131k izin s\u00fcreleri<\/b><span style=\"font-weight: 400;\"> de ya\u015f fakt\u00f6r\u00fc esas\u0131na dayan\u0131r. Emekli olduktan sonra \u00e7al\u0131\u015fmaya devam edenler i\u00e7in yasa kapsam\u0131nda belirlenen hak edi\u015f 20 g\u00fcn olarak dikkat \u00e7eker.<\/span><\/p>\n<h2><b>Y\u0131ll\u0131k izin s\u00fcrelerine hafta sonu dahil mi?<\/b><\/h2>\n<p><b>\u00d6zel sekt\u00f6r y\u0131ll\u0131k izin s\u00fcreleri<\/b><span style=\"font-weight: 400;\"> k\u0131dem kapsam\u0131nda de\u011fi\u015fir. \u00c7o\u011fu \u00e7al\u0131\u015fan hafta sonlar\u0131n\u0131n senelik iznine dahil olup olmad\u0131\u011f\u0131n\u0131 merak eder. S\u00fcrelerin belirlenmesinde birden fazla fakt\u00f6r mevcuttur. Bunlardan biri de <\/span><b>ya\u015fa g\u00f6re y\u0131ll\u0131k izin s\u00fcreleri<\/b><span style=\"font-weight: 400;\"> \u015feklindedir. Ya\u015f durumuna ve sekt\u00f6re, k\u0131deme g\u00f6re de\u011fi\u015fen s\u00fcreler konusunda detayl\u0131 bilgi sahibi olman gerekir. Memurlar i\u00e7in belirlenen g\u00fcn say\u0131s\u0131na hafta sonu da dahil edilir. \u00d6zel sekt\u00f6r \u00e7al\u0131\u015fanlar\u0131 i\u00e7in ise 4857 say\u0131l\u0131 \u0130\u015f Kanunu&#8217;nda farkl\u0131 bir d\u00fczenleme yap\u0131lm\u0131\u015ft\u0131r. Kanunun 56. Maddesinde detayl\u0131 olarak yer verilen bu hususa g\u00f6re bayram tatilleri, genel tatiller ve hafta sonu tatil g\u00fcnleri bu s\u00fcre i\u00e7inde say\u0131lmaz. Bu a\u00e7\u0131klama ayn\u0131 zamanda <\/span><b>y\u0131ll\u0131k izin s\u00fcreleri hafta sonu dahil mi<\/b><span style=\"font-weight: 400;\"> sorusunun da yan\u0131t\u0131n\u0131 te\u015fkil eder. Sen de izin g\u00fcnlerin hakk\u0131nda bilgi sahibi olmak istiyorsan <\/span><b>form\u00fcll\u00fc y\u0131ll\u0131k izin tablosu<\/b><span style=\"font-weight: 400;\"> gibi \u00e7\u00f6z\u00fcmlerden faydalanabilirsin.<\/span><\/p>\n<h2><b>\u0130\u015fveren y\u0131ll\u0131k izin vermek zorunda m\u0131?<\/b><\/h2>\n<p><b>Y\u0131ll\u0131k izin hakedi\u015f s\u00fcreleri<\/b><span style=\"font-weight: 400;\"> \u00f6zel ya da kamu \u00e7al\u0131\u015fan\u0131 olmak fark etmeksizin \u00e7al\u0131\u015fanlar\u0131n en temel haklar\u0131 aras\u0131ndad\u0131r. Anayasa\u2019da da yer verilen bu hakk\u0131n i\u015fverenler taraf\u0131ndan \u00e7al\u0131\u015fanlara kesintisiz sunulmas\u0131 gerekir ve <\/span><b>i\u015fveren y\u0131ll\u0131k izin vermek zorunda m\u0131<\/b><span style=\"font-weight: 400;\"> sorusunun yan\u0131t\u0131n\u0131 olu\u015fturur. \u00c7al\u0131\u015fmaya devam edildi\u011fi s\u00fcrece i\u015fveren \u00e7al\u0131\u015fan\u0131n bu hakk\u0131n\u0131 vermekle y\u00fck\u00fcml\u00fcd\u00fcr. K\u0131dem, ya\u015f ve benzeri fakt\u00f6rler kapsam\u0131nda hak edi\u015fi olmu\u015f her \u00e7al\u0131\u015fan i\u015fverenden bu hakk\u0131n\u0131 \u00fccret ya da g\u00fcn olarak talep edebilir. <\/span><b>Y\u0131ll\u0131k izin s\u00fcreleri ya\u015fa g\u00f6re<\/b><span style=\"font-weight: 400;\">, emekli olmaya ve k\u0131deme g\u00f6re de\u011fi\u015fti\u011fi i\u00e7in hak edi\u015flerini takip etmen ve buna g\u00f6re talep etmen tavsiye edilir. <\/span><b>Y\u0131ll\u0131k izin art\u0131\u015f s\u00fcreleri <\/b><span style=\"font-weight: 400;\">de i\u015f\u00e7inin k\u0131demine g\u00f6re 14 g\u00fcn, 20 g\u00fcn veya 26 g\u00fcn \u015feklindedir. Yasa kapsam\u0131nda t\u00fcm haklar\u0131n\u0131 detayl\u0131 olarak \u00f6\u011frenip talebini i\u015fverenine iletebilirsin.<\/span><\/p>\n<h2><b>Y\u0131ll\u0131k izin \u00fccreti hangi \u015fartlarda al\u0131nabilir?<\/b><\/h2>\n<p><b>Sigortal\u0131 y\u0131ll\u0131k izin s\u00fcreleri<\/b><span style=\"font-weight: 400;\"> \u00f6zel sekt\u00f6rde k\u0131deme ve ya\u015fa g\u00f6re belirlenir. Kanuni olarak sunulan bu hakk\u0131ndan faydalanabilmen i\u00e7in t\u00fcm \u015fartlar\u0131 yerine getirmen gerekir. Bu \u015fartlardan ilki mevcut i\u015f yerinde en az 1 senedir \u00e7al\u0131\u015f\u0131yor olmand\u0131r. 1 seneden daha az \u00e7al\u0131\u015ft\u0131ysan hakk\u0131n hen\u00fcz olu\u015fmaz. \u00d6rne\u011fin; kamuda hizmet veren<\/span><a href=\"https:\/\/www.kariyer.net\/pozisyonlar\/edebiyat+ogretmeni\" target=\"_blank\" rel=\"noopener\"> <span style=\"font-weight: 400;\">edebiyat \u00f6\u011fretmeni<\/span><\/a><span style=\"font-weight: 400;\"> pozisyonunda \u00e7al\u0131\u015f\u0131yorsan memur kapsam\u0131ndas\u0131n demektir.
